【摘要】：自2000年起,福建省開始積極探索和推進公證機構(gòu)改革,通過整合、轉(zhuǎn)制、撤并,截止2014年全省共有90家公證處,有的還保留行政單位,有的轉(zhuǎn)制為全額撥款或差額撥款事業(yè)單位,有的轉(zhuǎn)型為自主經(jīng)營、自負(fù)盈虧的自收自支制事業(yè)單位,還有純市場化運行模式的合作制,全省公證行業(yè)呈現(xiàn)出相對復(fù)雜和混亂的狀態(tài)。近年來,隨著虛假公證、負(fù)面新聞的曝光,公證公信力受到重大沖擊,公證行業(yè)受到社會的質(zhì)疑和猜忌,并一度有被“邊緣化”的危機。因此,如何找準(zhǔn)公證行業(yè)的發(fā)展定位,重塑公證公信力,對于促進福建省乃至全國公證行業(yè)的發(fā)展完善具有重大意義。 本文從公共管理的視角出發(fā),以公共產(chǎn)品、事業(yè)單位分類改革及第三部門等理論為基礎(chǔ),采用文獻資料查閱、問卷調(diào)查、調(diào)研訪談為工具,首先厘清公證的相關(guān)概念界定,并闡述福建省公證行業(yè)的機構(gòu)、管理、業(yè)務(wù)現(xiàn)狀和組織模式等發(fā)展現(xiàn)狀；其次,采取圖表化數(shù)據(jù)、表格化比較、問卷調(diào)查等形式,針對福建省公證行業(yè)不同組織形式的相關(guān)情況進行對比分析,包括轄區(qū)影響因素、基本建設(shè)、運行管理、隊伍建設(shè)、業(yè)務(wù)開展等狀況以及社會效果的比較,客觀反映福建省公證行業(yè)的發(fā)展?fàn)顩r；再次,結(jié)合上述的研究分析,探討福建省公證行業(yè)發(fā)展在組織形式、職能作用、管理模式、隊伍建設(shè)等方面存在的問題,并逐一分析原因所在；最后,基于福建省公證行業(yè)多元化機構(gòu)類型并存的現(xiàn)狀,提出完善制度規(guī)定、理順管理體制、加強隊伍建設(shè)、強化激勵機制、增強公眾認(rèn)同的對策和建議,以期對福建省公證行業(yè)的發(fā)展完善提供有益的參考。經(jīng)過對比分析,本文認(rèn)為福建省現(xiàn)階段宜將公證機構(gòu)定位為公益三類的機構(gòu)性質(zhì),并繼續(xù)擴大合作制試點。但是,隨著社會經(jīng)濟的發(fā)展和誠信機制的健全,公證機構(gòu)應(yīng)回歸社會中介組織的第三部門屬性,采取合作制等靈活形式,以實現(xiàn)公證行業(yè)的長久發(fā)展。
[Abstract]:Since 2000, Fujian Province has been actively exploring and promoting the reform of notarization organizations. Through integration, transformation, withdrawal and merger, there are 90 notary offices in the province by 2014, some of which still retain administrative units. Some of them have been transformed into institutions with full or differential allocations, others have been transformed into self-supporting institutions operating on their own, self-supporting institutions that are responsible for their own profits and losses, and cooperative systems based on a purely market-oriented mode of operation. Provincial notarization industry presents a relatively complex and chaotic state. In recent years, with the exposure of false notarization and negative news, the public credibility of notarization has been greatly impacted, the notarization industry has been questioned and suspected by the society, and there was once a crisis of "marginalization". Therefore, how to find the development orientation of notarization industry and rebuild the public trust of notarization is of great significance to promote the development and perfection of notarization industry in Fujian Province and even in the whole country. From the perspective of public management, based on the theories of public goods, public institution classification reform and the third sector, this paper uses literature review, questionnaire survey, investigation and interview as a tool to clarify the definition of relevant concepts of notarization. It also expounds the development status of the organization, management, business and organization mode of the notarization industry in Fujian Province. Secondly, it takes the form of chart data, tabular comparison, questionnaire survey and so on. This paper makes a comparative analysis of the different organizational forms of the notarization industry in Fujian Province, including the influencing factors of the jurisdiction, capital construction, operation management, team building, business development and social effects. Objectively reflect the development of the notarization industry in Fujian Province; thirdly, based on the above research and analysis, discuss the problems existing in the organizational form, function, management mode, team construction, etc., of the development of the notarization industry in Fujian Province. Finally, based on the coexistence of diversified institutional types in the notarization industry of Fujian Province, the author proposes to perfect the system and regulations, to rationalize the management system, to strengthen the team building, and to strengthen the incentive mechanism. The countermeasures and suggestions to enhance public identity are expected to provide a useful reference for the development and perfection of the notarization industry in Fujian Province. Through comparative analysis, this paper thinks that Fujian Province should position notarization institutions as three types of public welfare institutions at present, and continue to expand the cooperative system pilot. However, with the development of social economy and the perfection of credit mechanism, notary institutions should return to the third sector attribute of social intermediary organizations and adopt flexible forms such as cooperative system in order to realize the long-term development of notarization industry.
