【摘要】：土地是人類生存和發(fā)展的載體，是不可再生的稀缺資源，因此土地管理是政府公共管理的一項重要內容。土地管理的一個重要方面是對違法用地行為的監(jiān)管。近年來，隨著我國城市化進程的加快，，各級政府和各類市場主體對土地的需求越趨增長，農村特別是城鄉(xiāng)邊緣地帶的土地利用出現(xiàn)了一系列的問題。村集體正在快速發(fā)展成為違法用地行為的主要實施者，這已成為政府公共管理實踐中重點關注的問題。為此，本文嘗試以制度分析作為研究視角，選取了廣東省江門市A市作為研究區(qū)域，以公共治理理論、理性選擇理論、制度變遷理論及利益相關者理論為主要依據(jù)，采用文獻研究法、案例分析法、調研分析法等研究方法。首先，掌握A市村集體違法用地行為的狀況和特點，指出A市治理村集體違法用地的現(xiàn)狀和存在問題；其次，在此基礎上，對在我國土地管理制度、農村治理體制、政府財政體制等制度變革下A市農村集體土地利益相關者的利益關系變化進行研究，從中分析村集體在現(xiàn)行制度安排中的利益得失，深入剖析A市村集體違法用地誘因；然后，借鑒國內其他城市治理違法用地的經驗作法；最后結合我國土地管理相關制度情況、A市村集體違法用地情況，在參考國內城市土地違法治理的相關經驗的基礎上，從國家層面延伸至地方層面提出治理村集體違法用地對策建議，希望能為政府在土地管理實踐方面提供一定參考價值。
[Abstract]:Land is the carrier of human survival and development, and is a non-renewable scarce resource, so land management is an important part of government public management. An important aspect of land management is the regulation of illegal land use. In recent years, with the acceleration of the urbanization process in China, the demand for land is increasing at all levels of government and all kinds of market subjects. A series of problems have appeared in the land use in rural areas, especially in the marginal areas of urban and rural areas. The village collective is rapidly developing into the main executor of illegal land use behavior, which has become the focus of attention in the practice of government public management. Therefore, this paper tries to take the institutional analysis as the research angle, selects Jiangmen A city in Guangdong Province as the research area, taking the public governance theory, the rational choice theory, the institutional change theory and the stakeholder theory as the main basis. Literature research method, case analysis method, investigation analysis method and other research methods. First of all, we should grasp the situation and characteristics of collective illegal land use in A city, and point out the present situation and existing problems of collective illegal land use in A city. Secondly, on the basis of this, the paper analyzes the land management system and rural governance system in our country. The change of interest relationship of rural collective land stakeholders in A city is studied under the system reform of government financial system, from which the gain and loss of village collective interest in the current system arrangement are analyzed, and the inducement of collective illegal land use in A city is deeply analyzed. Finally, according to the related system of land management in China and the situation of collective illegal land use in villages in A city, based on the relevant experience of illegal management of urban land in China, From the national level to the local level, the author puts forward the countermeasures and suggestions for the management of the village collective illegal land, hoping to provide a certain reference value for the government in the practice of land management.
