【摘要】：海關(guān)是國(guó)家的進(jìn)出關(guān)境監(jiān)督管理機(jī)關(guān),擔(dān)負(fù)著保障國(guó)家經(jīng)濟(jì)、政治安全和穩(wěn)定的職責(zé),海關(guān)公務(wù)員責(zé)任體系建設(shè)直接關(guān)系到海關(guān)有效監(jiān)管、高效運(yùn)作的能力。當(dāng)前,我國(guó)以法律法規(guī)形式設(shè)計(jì)了行政執(zhí)法責(zé)任制和黨風(fēng)廉政建設(shè)責(zé)任制等責(zé)任制度,與海關(guān)行政執(zhí)法、紀(jì)檢監(jiān)察和干部人事管理等工作機(jī)制共同構(gòu)成海關(guān)公務(wù)員責(zé)任體系。當(dāng)前,海關(guān)公務(wù)員責(zé)任體系還存在諸多問(wèn)題,具體體現(xiàn)在各項(xiàng)責(zé)任制度設(shè)計(jì)相互交叉重疊,對(duì)于海關(guān)公務(wù)員的責(zé)任設(shè)定、責(zé)任行使、責(zé)任評(píng)價(jià)和追究缺乏頂層設(shè)計(jì),導(dǎo)致海關(guān)公務(wù)員履行職責(zé)時(shí)監(jiān)督制約乏力,出現(xiàn)執(zhí)法腐敗、執(zhí)法差錯(cuò)等問(wèn)題后責(zé)任追究難以落實(shí)到位。因此,完善海關(guān)公務(wù)員責(zé)任體系成為建設(shè)責(zé)任型海關(guān)的必然途徑。 海關(guān)公務(wù)員責(zé)任體系的研究涉及公共管理學(xué)、行政法學(xué)和人力資源管理學(xué)等多個(gè)學(xué)科,本文作為公共管理專業(yè)碩士學(xué)位論文,側(cè)重于具體問(wèn)題的挖掘、分析和解決。本文的研究在閱讀大量國(guó)內(nèi)外關(guān)于責(zé)任政府、政府責(zé)任體系、行政問(wèn)責(zé)等文獻(xiàn)的基礎(chǔ)上,通過(guò)實(shí)地考察掌握海關(guān)公務(wù)員責(zé)任體系建設(shè)的豐富原始素材,以質(zhì)性研究為主。對(duì)于海關(guān)公務(wù)員責(zé)任體系的構(gòu)建,本文提出將有關(guān)于海關(guān)公務(wù)員責(zé)任的一系列制度、機(jī)制視為一個(gè)完整的系統(tǒng),包括組織人事制度、執(zhí)法監(jiān)督制度和考核激勵(lì)機(jī)制的觀點(diǎn),并對(duì)責(zé)任體系逐步趨向健全的發(fā)展和主要問(wèn)題展開(kāi)了論述。最后,本文在對(duì)海關(guān)公務(wù)員責(zé)任體系結(jié)構(gòu)分析和問(wèn)題剖析的基礎(chǔ)上提出從責(zé)任設(shè)定、職責(zé)履行、考核評(píng)價(jià)和激勵(lì)追究各個(gè)層面予以完善的對(duì)策,主要包括建立海關(guān)公務(wù)員分類制度、海關(guān)組織由科層制向扁平化轉(zhuǎn)變、完善權(quán)力監(jiān)督制約和建立責(zé)任導(dǎo)向的海關(guān)執(zhí)法考核評(píng)價(jià)制度等具體措施。對(duì)于實(shí)現(xiàn)海關(guān)職能轉(zhuǎn)變、構(gòu)建責(zé)任海關(guān)具有一定的應(yīng)用價(jià)值。
[Abstract]:Customs is the supervision and administration organ of the national entry and exit border, which is responsible for ensuring the national economy, political security and stability. The construction of the civil service responsibility system of customs is directly related to the ability of effective supervision and efficient operation of customs. At present, in the form of laws and regulations, China has designed the responsibility system of administrative law enforcement responsibility system and party style and clean government construction responsibility system, which, together with the working mechanism of customs administration law enforcement, discipline inspection and supervision and cadre personnel management, constitutes the duty system of customs civil servants. At present, there are still many problems in the responsibility system of customs civil servants, which are embodied in the overlapping design of each responsibility system, the lack of top-level design for the duty setting, responsibility exercise, responsibility evaluation and accountability of customs civil servants. As a result, the supervision and restriction of customs civil servants are weak, the problems of law enforcement corruption, law enforcement errors and so on are difficult to be carried out. Therefore, perfecting the duty system of customs civil servants becomes an inevitable way to build responsible customs. The research of civil servant responsibility system of customs involves many subjects, such as public management, administrative law and human resource management. As a master's degree thesis of public management, this paper focuses on the excavation, analysis and solution of specific problems. On the basis of reading a large number of domestic and foreign documents on responsible government, government responsibility system, administrative accountability and so on, this study grasps the rich raw materials of the construction of civil service responsibility system of customs through on-the-spot investigation, focusing on qualitative research. For the construction of the civil service responsibility system of customs, this paper puts forward the viewpoint that there are a series of systems concerning the responsibility of customs civil servants, and the mechanism is regarded as a complete system, including the organizational and personnel system, the supervision system of law enforcement and the examination and encouragement mechanism. At the same time, the development and main problems of responsibility system are discussed. Finally, on the basis of analyzing the structure and problems of the civil servants' responsibility system, this paper puts forward some countermeasures to perfect the system from the aspects of responsibility setting, duty fulfillment, evaluation and incentive. It mainly includes the establishment of the classification system of customs civil servants, the transformation of customs organization from hierarchy to flattening, the improvement of power supervision and restriction, and the establishment of a duty oriented assessment system for customs law enforcement and other concrete measures. It has certain application value for realizing the transformation of customs function and constructing responsible customs.
