論大學章程的功能

【摘要】:《國家中長期教育改革和發(fā)展規(guī)劃綱要(2010—2020年)》將“加強章程建設”作為中國特色現(xiàn)代大學制度建設的一項重要目標,制定大學章程被確認為是大學最為重要的權利和義務。對于大學章程的研究多停留在文本建設層面,缺乏對于章程功能的思考,導致其作用不能得到有效發(fā)揮。大學章程的功能是章程本身固有價值的體現(xiàn),是章程作用產(chǎn)生的內(nèi)部根據(jù)和前提條件,更是大學章程建設的出發(fā)點和落腳點,需要我們進一步探討其內(nèi)容,明晰政府與大學的關系,找到平衡校內(nèi)各種權力的方法,從而有效推進我國大學章程建設。因此,本研究擬將根據(jù)大學理念及章程的變化,透視大學章程功能的演變,從大學不同的制度背景、歷史使命中提煉影響大學章程功能定位的因素,總結我國章程的發(fā)展狀況,以解決我國大學章程中的問題為目的,適應我國現(xiàn)代化大學改革的要求,針對我國大學的章程功能建構給出自己的見解和對策。 本文文本部分有六大塊,第一部分是本文的緒論,主要內(nèi)容涵蓋了行文背景、研究對象,對涉及的主要概念進行界定,討論作用與功能的不同。第二部分分析了所收集到的文獻資料,探討大學章程功能在不同時代背景下的演變,傳統(tǒng)的大學章程注重維護大學自治和學術自由的功能,而在新公共管理理論影響下,大學章程功能體現(xiàn)出公益性、服務性、參與性要求。第三部分在第二部分的基礎上,總結了影響大學章程功能的因素:制度背景和大學使命。第四部分著重描寫的是我國大學章程的歷史沿革,分析我國章程功能缺失的制度性障礙。第五部分是基于前四部分的總結,針對我國大學章程功能建構提出意見和建議,即對外需明確國家與大學的關系,對內(nèi)需平衡各種權力關系。第六部分是結語,總結概括前面的內(nèi)容,表達對于大學章程功能構建的美好期待。
[Abstract]:"strengthening the constitution construction" is regarded as an important goal in the construction of modern university system with Chinese characteristics, and the formulation of university charter is recognized as the most important right and duty of the university. The research on the university charter mostly stays at the level of text construction and lacks the thinking about the function of the charter, which results in its function being unable to be effectively played. The function of the university charter is the embodiment of the inherent value of the charter itself, the internal basis and precondition of the constitution function, and the starting point and the foothold of the university charter construction. To clarify the relationship between the government and the university, to find a way to balance all kinds of power in the university, so as to promote the constitution construction of the university in our country effectively. Therefore, according to the changes of the concept and charter of the university, this study intends to examine the evolution of the function of the charter of the university, abstract the factors that affect the function orientation of the charter from the different institutional background and historical mission of the university, and sum up the development of the charter in our country. In order to solve the problems in the university charter of our country and adapt to the requirements of the reform of the modern university in our country, the author puts forward his own opinions and countermeasures for the function construction of the charter of the university in our country. There are six parts in the text of this paper. The first part is the introduction of this paper. The main content covers the background of the text, the object of study, the definition of the main concepts involved, the discussion of the role and function of the difference. The second part analyzes the literature collected, discusses the evolution of the function of the university charter under the different times background, the traditional university charter pays attention to the function of safeguarding the university autonomy and the academic freedom, but under the influence of the new public management theory. The function of university charter embodies the requirements of public welfare, service and participation. On the basis of the second part, the third part summarizes the factors that affect the function of university charter: institutional background and university mission. The fourth part focuses on the historical evolution of the university charter and analyzes the institutional obstacles of the absence of the function of the constitution. The fifth part is based on the summary of the first four parts, aiming at the function construction of the university charter in our country, the author puts forward some opinions and suggestions, that is, to clarify the relationship between the state and the university, and to balance all kinds of power relations to the domestic demand. The sixth part is the conclusion, summarizes the previous content, expresses the good expectation for the university charter function construction.
