我國政府職能轉(zhuǎn)變下的公共行政民營化研究

【摘要】:隨著公共行政事務(wù)日益繁多和復(fù)雜化,傳統(tǒng)的行政管理模式和機(jī)制在面對(duì)行政事務(wù)繁多和公眾對(duì)政府的期待和要求越來越高時(shí)就顯得反應(yīng)遲緩,無法提供多樣化、高標(biāo)準(zhǔn)、高質(zhì)量公共服務(wù),從而推動(dòng)了公共行政民營化改革在全球范圍內(nèi)興起。公共行政民營化改革契合了法治政府的創(chuàng)新社會(huì)管理的理念,也是行政體制改革、轉(zhuǎn)變政府職能,建設(shè)服務(wù)型政府的題中應(yīng)有之義。在公共行政改革中,民營化作為一種改革的方式,也是政府治理的一種新的理念,打破政府壟斷公共行政事務(wù)的局面,更多更好依靠企業(yè)、社會(huì)組織等非政府機(jī)構(gòu)履行公共行政職能,滿足社會(huì)公眾對(duì)公共服務(wù)更多的期待,更好提供公共服務(wù),提升公共服務(wù)的質(zhì)量。本文梳理了各種文獻(xiàn)資料,在綜合和總結(jié)國內(nèi)外關(guān)于公共行政民營化研究成果的基礎(chǔ)上闡述在我國政府職能轉(zhuǎn)變條件下如何有效推進(jìn)公共行政民營化改革。 對(duì)公共行政民營化改革進(jìn)行研究需要對(duì)公共行政民營化進(jìn)行總體把握,了解公共行政民營化在全球范圍內(nèi)興起的背景,通過詮釋公共行政和民營化的含義,明晰公共行政民營化的概念。敘述了作為公共行政民營化的理論基礎(chǔ)公共選擇理論、治理理論、新公共管理理論的內(nèi)容。通過公共行政民營化的現(xiàn)狀的分析,對(duì)公共行政民營化依據(jù)不同的標(biāo)準(zhǔn)進(jìn)行分類,具體闡述公共行政民營化的實(shí)施方式。介紹英美國家公共行政民營化改革的實(shí)踐,總結(jié)其改革的特點(diǎn)和成功之處,并梳理我國公共行政民營化的實(shí)踐,明晰改革的范圍領(lǐng)域和存在的問題。 公共行政民營化的改革方式之所以被各國采用因其具有一定的積極意義,如拓寬公共服務(wù)的渠道、提高行政效能、轉(zhuǎn)變政府管理模式等諸多意義,同時(shí)公共行政民營化改革也出現(xiàn)了許多問題,如依據(jù)的規(guī)范性文件位介較低、界限不清晰、責(zé)任不明確等。針對(duì)上文敘述的我國公共行政民營化存在的問題,從法律調(diào)整的角度來論述我國公共行政民營化改革需要在那些方面進(jìn)行調(diào)整、規(guī)范、規(guī)制。確定公共行政民營化的范圍,不可單一采用羅列的方式去劃定范圍,應(yīng)該采用禁止和限定的方式來明晰范圍,通過對(duì)涉及國家核心功能、公共安全、公民基本權(quán)利和自由等事項(xiàng)進(jìn)行圈定明確公共行政民營化改革領(lǐng)域的禁區(qū),同時(shí)對(duì)法律允許的公用行政領(lǐng)域哪些公共產(chǎn)品和服務(wù)能夠采用民營化的方式提供進(jìn)行概括性的劃定。完善公共行政民營化的法律程序,只有通過設(shè)定的公正的程序,才能選擇出實(shí)力雄厚、工作效率高、提供的服務(wù)質(zhì)量好的私營部門來承擔(dān)公共行政事務(wù)的任務(wù)。公正的法律程序關(guān)系到公共行政民營化改革能否順利推進(jìn),公共利益是否能夠得到保障。政府的監(jiān)督規(guī)制是保障公共行政民營化改革成功的關(guān)鍵一步,通過設(shè)定相對(duì)獨(dú)立的監(jiān)督主體、創(chuàng)新監(jiān)督方式、完善績效監(jiān)督考核機(jī)制、強(qiáng)化政府在民營化中的監(jiān)督責(zé)任,確保提供公共服務(wù)的私營部門更好的履行其職責(zé),為社會(huì)公眾提供高質(zhì)量的服務(wù),實(shí)現(xiàn)公共行政民營化改革的既定目標(biāo)。
[Abstract]:With the increasing diversity and complexity of the public administration affairs, the traditional administrative mode and mechanism appear to be slow in response to a wide range of administrative affairs and the public's expectations and demands for the government, which can not provide diversification, high standards and high quality public services, thus promoting the global reform of the privatization of public administration in the global scope. The reform of the privatization of public administration coincides with the idea of the innovation of social management by the rule of law, the reform of the administrative system, the transformation of the functions of the government and the construction of a service-oriented government. In the reform of public administration, the privatization as a way of reform is a new concept of government governance, and it breaks the government monopoly public. The situation of administrative affairs is more and better to rely on the non-governmental organizations such as enterprises, social organizations and other non-governmental organizations to fulfill the public administrative functions, meet the public's expectation of public service, provide better public services and improve the quality of public services. This paper has combed various documents and summarized the research on the privatization of public administration at home and abroad. Based on the achievements, this paper expounds how to effectively push forward the privatization of public administration under the transformation of government functions.
The study of privatization of public administration needs to have a general grasp of the privatization of public administration, to understand the background of the rise of the privatization of public administration in the world, and to clarify the concept of privatization of public administration through the interpretation of the meaning of public administration and privatization, and to describe the public choice of the theoretical basis for the privatization of public administration. The content of theory, governance theory and new public management theory. Through the analysis of the present situation of the privatization of public administration, this paper classifies the privatization of public administration according to the different standards, expounds the implementation mode of the privatization of public administration, introduces the practice of the privatization reform of public administration in the Anglo American countries, and summarizes the characteristics and success of the reform. And comb the practice of privatization of public administration in China, clarify the scope and problems of reform.
The reform mode of the privatization of public administration has been adopted by various countries for its positive significance, such as broadening the channels of public service, improving the administrative efficiency and changing the government management mode. Meanwhile, there have been many problems in the reform of the privatization of public administration, such as the low standard of the standard documents and the unclear boundaries. In view of the problems existing in the privatization of public administration described above in our country, it is necessary to adjust, standardize and regulate the privatization of public administration in our country from the angle of legal adjustment. The scope of privatization of public administration should be determined, and the scope of the privatization of public administration should not be defined by a single way, and the prohibition should be adopted. To clarify the scope and define the forbidden areas in the field of privatization of public administration through the matters involving the core functions of the state, public security, the basic rights and freedoms of the citizens, and to provide a summary of which public products and services can be privatized in the field of public administration that are permitted by law. In order to improve the legal procedure of the privatization of public administration, only by setting a fair procedure can we choose the task of the private sector with strong strength, high work efficiency and good service quality to undertake the task of public administration. The fair legal procedure is related to the smooth promotion of the privatization reform of the public administration and the public interest. The government supervision and regulation is the key step to ensure the success of the reform of the privatization of public administration. By setting a relatively independent supervision body, innovating the supervision mode, improving the performance supervision and assessment mechanism, strengthening the government's supervision responsibility in privatization, and ensuring the private sector providing public service to better perform it Responsibilities, providing high quality services for the public, and achieving the established goal of privatization of public administration.
