【摘要】：在國家不斷對質(zhì)量技術(shù)監(jiān)督系統(tǒng)進(jìn)行強(qiáng)化執(zhí)法的大背景下,廣州市質(zhì)量技術(shù)監(jiān)督部門近年來不斷加強(qiáng)執(zhí)法力度,執(zhí)法環(huán)境也在不斷改善,但在具體執(zhí)法實(shí)踐中仍存在著一些問題與困境：假冒偽劣新態(tài)勢、新特征不斷涌現(xiàn),監(jiān)督執(zhí)業(yè)人員結(jié)構(gòu)發(fā)展不平衡,監(jiān)督管理存在缺位,執(zhí)法部門職責(zé)不清,處罰力度較弱等。 本文主要依據(jù)政府管理理論、新公共服務(wù)理論和新公共管理理論,針對廣州市質(zhì)量技術(shù)監(jiān)督打假治劣的現(xiàn)狀及存在的問題進(jìn)行深入的分析研究,從監(jiān)督管理機(jī)制、法治建設(shè)、執(zhí)業(yè)人員結(jié)構(gòu)配置、產(chǎn)品標(biāo)準(zhǔn)的設(shè)立、產(chǎn)品質(zhì)量監(jiān)督抽查的效力、誠信體系的建設(shè)等方面探討目前廣州市質(zhì)量技術(shù)監(jiān)督打假治劣困境產(chǎn)生的深層原因。 根據(jù)廣州市質(zhì)量技術(shù)監(jiān)督打假治劣困境產(chǎn)生的原因,對比國外一些發(fā)達(dá)國家有關(guān)質(zhì)量技術(shù)監(jiān)督行政執(zhí)法方面的先進(jìn)經(jīng)驗(yàn),從完善監(jiān)督管理機(jī)制、加強(qiáng)法律體系建設(shè)、提高執(zhí)業(yè)人員素質(zhì)、建立科學(xué)的質(zhì)量標(biāo)準(zhǔn)體系、完善產(chǎn)品抽查制度、加快誠信體系建設(shè)等方面提出了完善廣州市質(zhì)量技術(shù)監(jiān)督打假治劣的對策建議,以解決廣州市目前所面臨的質(zhì)量技術(shù)監(jiān)督打假治劣的難題。
[Abstract]:Against the background of the state's continuous efforts to strengthen the law enforcement of the quality and technology supervision system, the quality and technical supervision department of Guangzhou has continuously strengthened its law enforcement efforts in recent years, and the law enforcement environment has also been continuously improved. However, there are still some problems and difficulties in the practice of law enforcement: fake and shoddy new situation, new features emerge constantly, the structure of supervision practitioners is not balanced, supervision and management is absent, the responsibilities of law enforcement departments are not clear, and punishment is weak, and so on. Based on the theory of government management, the theory of new public service and the theory of new public management, this paper makes a deep analysis and research on the current situation and existing problems of quality and technical supervision in Guangzhou, from the supervision and management mechanism, the construction of rule of law. This paper probes into the deep causes of the difficult position of quality and technical supervision in Guangzhou at present from the aspects of the configuration of professional personnel, the establishment of product standard, the effectiveness of product quality supervision and spot check, the construction of credit system, and so on. According to the causes of the difficult situation of quality and technology supervision in Guangzhou, comparing with the advanced experience of some developed countries in quality and technology supervision and administrative law enforcement, we should improve the supervision and management mechanism and strengthen the construction of the legal system. In order to improve the quality of practitioners, establish a scientific quality standard system, perfect the system of product spot check, and speed up the construction of credit system, this paper puts forward some countermeasures and suggestions for perfecting quality and technical supervision in Guangzhou.
