【摘要】：紐約的攤販治理策略是對(duì)攤販群體生存智慧和憲法權(quán)利的尊重與保障,也是對(duì)其他群體正當(dāng)利益和合理訴求的維護(hù)與回應(yīng),是政府、社會(huì)、企業(yè)和公民之間合作共治的產(chǎn)物。基于紐約街頭攤販治理的分析,可以發(fā)現(xiàn),攤販治理的有效性有賴于三個(gè)條件:一是廣泛的公眾參與,二是有效的集體行動(dòng),三是由周全、細(xì)密的法規(guī)體系和專業(yè)、獨(dú)立的監(jiān)管機(jī)構(gòu)與剛?cè)岵?jì)的執(zhí)法策略構(gòu)筑的良好治理體系。
[Abstract]:The management strategy of vendors in New York is the respect and guarantee of the survival wisdom and constitutional rights of the vendors, and the protection and response to the legitimate interests and reasonable demands of other groups. It is also the product of cooperation and co-governance among the government, society, enterprises and citizens.Based on the analysis of the governance of street vendors in New York, it can be found that the effectiveness of the governance of vendors depends on three conditions: one is extensive public participation, the other is effective collective action, and the third is a comprehensive and detailed legal system and a professional system.A good governance system constructed by independent regulators and a firm and flexible law enforcement strategy.
