【摘要】：在我國,近年來產(chǎn)品安全事件頻發(fā),成為各大媒體的頭版頭條,產(chǎn)品質(zhì)量安個問題日益突出,社會關(guān)注度空前高漲。這使與產(chǎn)品安全相關(guān)聯(lián)的質(zhì)監(jiān)部門,更被社會輿論推到風(fēng)口浪尖上,特別是基層質(zhì)監(jiān)部門,導(dǎo)致民眾對國產(chǎn)產(chǎn)品失去信心的同時,也對質(zhì)監(jiān)部門行使職權(quán)有了一定的質(zhì)疑。因此本文對河北省市質(zhì)監(jiān)部門當前執(zhí)法狀況的研究,提出存在的問題和分析原因,從政府公共管理的角度,探索提高質(zhì)量技術(shù)監(jiān)督部門整體執(zhí)法水平的對策,對提高河北省質(zhì)監(jiān)行政執(zhí)法水平、更好地促進河北省經(jīng)濟又好又快發(fā)展、保障人民群眾生命財產(chǎn)安全有著重要的現(xiàn)實意義。本文從當前河北省質(zhì)量監(jiān)督局行政執(zhí)法的現(xiàn)狀入手,以服務(wù)型政府和依法行政理論為指導(dǎo),結(jié)合河北省委改善兩個環(huán)境總體戰(zhàn)略,分析了河北省質(zhì)監(jiān)行政執(zhí)法目前存在的各種問題和風(fēng)險:監(jiān)管缺位導(dǎo)致的質(zhì)量安全事件頻發(fā)、行政訴訟案敗訴率上升、執(zhí)法人員被處理人數(shù)增多等。通過現(xiàn)象分析,從河北質(zhì)量技術(shù)監(jiān)督執(zhí)法主體、執(zhí)法對象、執(zhí)法環(huán)境等多角度全面尋找產(chǎn)生執(zhí)法風(fēng)險的原因:執(zhí)法制度不合理、執(zhí)法人員水平差、執(zhí)法對象不配合、執(zhí)法環(huán)境復(fù)雜等等。在此基礎(chǔ)上結(jié)合我國大部制改革與河北省質(zhì)量技術(shù)監(jiān)督部門體制調(diào)整的實際情況,有針對性地提出了加強質(zhì)監(jiān)部門自身建設(shè)、加強科學(xué)監(jiān)管、建立危機預(yù)警處理機制、調(diào)整各部門職能分工等19條具體、合理的政策性建議,初步形成了一套站位較高的多角度解決方案,希望改善質(zhì)監(jiān)部門的形象,指導(dǎo)執(zhí)法人員不斷提高自身執(zhí)法水平和服務(wù)質(zhì)量,進一步提高質(zhì)量技監(jiān)部門執(zhí)法水平和管理工作的有效性。
[Abstract]:In our country, product safety incidents frequently occur in recent years, which has become the front page of the major media. The problem of product quality has become increasingly prominent, and the social concern has never been higher.This makes the quality supervision department associated with product safety more popular opinion, especially the grass-roots quality supervision department, resulting in the loss of public confidence in domestic products, but also the exercise of the authority of the quality supervision department has a certain doubt.Therefore, this paper studies the current law enforcement situation of the quality supervision department in Hebei Province, puts forward the existing problems and analyzes the reasons, and explores the countermeasures to improve the overall law enforcement level of the quality and technical supervision department from the angle of government public management.It is of great practical significance to improve the administrative law enforcement level of quality supervision in Hebei Province, promote the economic development of Hebei Province well and quickly, and ensure the safety of people's lives and property.Based on the current situation of administrative law enforcement in Hebei Provincial quality Supervision Bureau, and guided by the service-oriented government and the theory of administration according to law, this paper combines the two overall strategies of improving the environment of Hebei Provincial Party Committee.This paper analyzes the problems and risks existing in the administrative enforcement of quality supervision in Hebei Province, such as the frequent occurrence of quality and safety incidents caused by the absence of supervision, the rise in the rate of defeat in administrative litigation cases, the increase in the number of law enforcement personnel dealt with, and so on.Through the analysis of the phenomena, the causes of the law enforcement risk are found from the aspects of Hebei quality and technical supervision, law enforcement object, law enforcement environment and so on: the law enforcement system is unreasonable, the level of law enforcement personnel is poor, the law enforcement object does not cooperate, etc.Complex law enforcement environment and so on.On this basis, in combination with the actual situation of the reform of the large Ministry of China and the system adjustment of the quality and technical supervision department in Hebei Province, the paper puts forward to strengthen the self-construction of the quality supervision department, strengthen the scientific supervision, and establish the mechanism of early warning and handling of the crisis.The 19 specific and reasonable policy recommendations on adjusting the division of functions and functions of various departments have preliminarily formed a set of multi-angle solutions with higher stations, hoping to improve the image of the quality supervision departments.Guide the law enforcement personnel to improve their own law enforcement level and service quality, and further improve the effectiveness of the law enforcement and management work of the quality technical supervision department.
