【摘要】：農(nóng)民工是我國特殊體制的產(chǎn)物。在我國社會保障體系整體尚不完善的情況下，由于勞動力市場的二元結(jié)構(gòu)限制，與城市居民相比，，農(nóng)民工在就業(yè)機(jī)會、工資待遇、工作條件、社會福利等各方面都存在著較大的差別。研究表明，盡管國家經(jīng)濟(jì)發(fā)展迅猛，但是農(nóng)民工工資增長比較緩慢，而且拖欠、克扣農(nóng)民工工資的現(xiàn)象比較普遍，農(nóng)民工工資難以得到應(yīng)有的保障。 本文在對現(xiàn)場調(diào)查資料整理匯總的基礎(chǔ)上，對農(nóng)民工工資的現(xiàn)狀進(jìn)行了研究。本文認(rèn)為，農(nóng)民工工資拖欠問題的根源在于相關(guān)法律法規(guī)不完善、執(zhí)法監(jiān)管不到位、農(nóng)民工缺乏組織和群體的幫助等。而農(nóng)民工工資增長緩慢的原因則在于政府公共管理落實(shí)不到位，行政執(zhí)法不力，相關(guān)的工資增長法律機(jī)制沒有得到很好的執(zhí)行等。這些現(xiàn)象都導(dǎo)致農(nóng)民工工資得不到應(yīng)有的保障。 本文重點(diǎn)闡明的主要觀點(diǎn)是——不能只把農(nóng)民工工資問題看作是一個法律和經(jīng)濟(jì)問題，而應(yīng)當(dāng)成一個普遍的社會問題加以解決。 文中從宏觀建設(shè)和微觀建設(shè)兩方面提出了建立農(nóng)民工工資保障機(jī)制的可行性措施。宏觀建設(shè)方面包括政策性調(diào)控與監(jiān)察導(dǎo)向、制度化約束與保障、企業(yè)戰(zhàn)略性薪酬的規(guī)范化、信用制的社會化發(fā)展等四項(xiàng)內(nèi)容。微觀建設(shè)方面包括規(guī)范企業(yè)勞動用工、企業(yè)勞資管理流程化、強(qiáng)化農(nóng)民工工資保障部門的執(zhí)法力度等三項(xiàng)內(nèi)容。 通過本課題研究，可以為探討農(nóng)民工這一工業(yè)化進(jìn)程中不可或缺的群體提供一個新的視角，為從社會經(jīng)濟(jì)發(fā)展的角度對當(dāng)今社會農(nóng)民工工資保障制度研究提供一定參考。
[Abstract]:Migrant workers are the product of our special system.Under the condition that the social security system in our country is not perfect, due to the restriction of the dual structure of the labor market, compared with the urban residents, migrant workers are in employment opportunities, wages, and working conditions.There are great differences in social welfare and other aspects.The research shows that although the national economy is developing rapidly, the wages of migrant workers are increasing slowly, and the wages of migrant workers are in arrears, the phenomenon of deducting migrant workers' wages is common, and the wages of migrant workers are difficult to be guaranteed.Based on the collection of field investigation data, this paper studies the status of migrant workers' wages.This paper argues that the problem of migrant workers' wage arrears is rooted in imperfect laws and regulations, inadequate enforcement and supervision, and lack of help from organizations and groups of migrant workers.The reasons for the slow wage growth of migrant workers are that the implementation of government public management is not in place, the administrative law enforcement is weak, and the relevant legal mechanism of wage growth has not been implemented very well.These phenomena lead to migrant workers' wages can not be guaranteed.The main point of this paper is that the issue of migrant workers' wages should not be regarded as a legal and economic issue, but as a general social problem.This paper puts forward the feasible measures to establish the wage guarantee mechanism of migrant workers from two aspects of macro construction and micro construction.Macroscopical construction includes four aspects: policy regulation and supervision, systematization restriction and guarantee, standardization of enterprise strategic salary, socialization development of credit system, etc.The micro construction includes three aspects: standardizing the labor and employment of enterprises, making the management of labor and capital flow, and strengthening the law enforcement of the wage security department of migrant workers.Through this research, we can provide a new angle of view for the discussion of migrant workers, an indispensable group in the process of industrialization, and provide a certain reference for the study of the wage security system of migrant workers from the perspective of social and economic development.
