【摘要】：改革開放以來(lái)，我國(guó)經(jīng)濟(jì)正處在高速發(fā)展，質(zhì)量問題已經(jīng)不僅是經(jīng)濟(jì)發(fā)展中的一個(gè)戰(zhàn)略問題，而且關(guān)系著人民群眾的切身利益，關(guān)系企業(yè)的生存和發(fā)展，關(guān)系國(guó)家形象和整個(gè)經(jīng)濟(jì)社會(huì)的健康發(fā)展，更是關(guān)系社會(huì)和諧穩(wěn)定的政治問題。在我國(guó)保障民生、構(gòu)建社會(huì)主義和諧社會(huì)的大背景下，質(zhì)量尤其重要，無(wú)論是消費(fèi)的增長(zhǎng)，還是企業(yè)的發(fā)展都離不開質(zhì)量的支撐，想提高人民群眾的生活水平更是應(yīng)該讓其對(duì)市場(chǎng)上產(chǎn)品的質(zhì)量放心，對(duì)生活安全放心。 在我國(guó)，近年來(lái)產(chǎn)品安全事件頻發(fā)，成為各大媒體的頭版頭條，產(chǎn)品質(zhì)量安全問題日益突出，社會(huì)關(guān)注度空前高漲。這使與產(chǎn)品安全相關(guān)聯(lián)的質(zhì)監(jiān)部門，更被社會(huì)輿論推到風(fēng)口浪尖上，特別是基層質(zhì)監(jiān)部門，導(dǎo)致民眾對(duì)國(guó)產(chǎn)產(chǎn)品失去信心的同時(shí)，也對(duì)質(zhì)監(jiān)部門行使職權(quán)有了一定的質(zhì)疑。因此對(duì)廣州市質(zhì)監(jiān)部門當(dāng)前執(zhí)法狀況的研究，提出存在的問題和分析原因，從政府公共管理的角度，探索提高質(zhì)量技術(shù)監(jiān)督部門整體執(zhí)法水平的對(duì)策，對(duì)提高廣州市質(zhì)監(jiān)行政執(zhí)法水平、更好地促進(jìn)廣州市經(jīng)濟(jì)又好又快發(fā)展、保障人民群眾生命財(cái)產(chǎn)安全有著重要的現(xiàn)實(shí)意義。 本文從當(dāng)前廣州市質(zhì)監(jiān)局行政執(zhí)法的現(xiàn)狀入手，以服務(wù)型政府和依法行政理論為指導(dǎo)，提出了廣州質(zhì)監(jiān)行政執(zhí)法存在問題，主要包括執(zhí)法力量和行政效率不高，執(zhí)法缺位與部門沖突，考核和檢驗(yàn)不合理，執(zhí)法難度大，強(qiáng)制措施不合理。并對(duì)這些問題進(jìn)行了進(jìn)行了原因分析，主要分析了6個(gè)方面的原因：行政設(shè)置需要改進(jìn)，執(zhí)法隊(duì)伍綜合優(yōu)勢(shì)不足，法律規(guī)定的部分情況操作性不強(qiáng)，內(nèi)部考核機(jī)制不合理，執(zhí)法環(huán)境未優(yōu)化，檢驗(yàn)機(jī)制不合理。在此基礎(chǔ)上，，最后從提高行政執(zhí)法隊(duì)伍素質(zhì)、強(qiáng)化培訓(xùn)、充實(shí)裝備和提高待遇、改革考核方式、發(fā)揮社會(huì)力量、部門和諧執(zhí)法、提高宣傳力度七個(gè)方面提出提高廣州質(zhì)監(jiān)局行政執(zhí)法能力的對(duì)策，從而改善質(zhì)監(jiān)部門的形象，指導(dǎo)執(zhí)法人員不斷提高自身執(zhí)法水平和服務(wù)質(zhì)量，進(jìn)一步提高質(zhì)量技監(jiān)部門執(zhí)法水平和管理工作的有效性。
[Abstract]:Since the reform and opening up, China's economy is developing at a high speed. The problem of quality is not only a strategic issue in economic development, but also relates to the vital interests of the people and the survival and development of enterprises. Concerning the image of the country and the healthy development of the whole economy and society, it is also a political issue related to the harmony and stability of the society. Under the background of safeguarding the people's livelihood and building a harmonious socialist society in our country, quality is especially important, whether it is the growth of consumption, The development of enterprises can not be separated from the support of quality. To improve the living standards of the people, it is necessary to rest assured of the quality of products on the market and the safety of life. In China, product safety incidents have frequently occurred in recent years, making them headlines in various major media. The problem of product quality and safety has become increasingly prominent and the social concern has never been higher. This has led to quality supervision departments associated with product safety. It has been pushed to the forefront by public opinion, especially the quality supervision departments at the grass-roots level, which has led the public to lose confidence in domestic products at the same time. It also has certain doubts about the exercise of the authority of the quality supervision department. Therefore, the study on the current law enforcement situation of the quality supervision department in Guangzhou puts forward the existing problems and analyzes the reasons, from the angle of the government's public administration. It is of great practical significance to explore the countermeasures to improve the law enforcement level of quality and technical supervision department in Guangzhou, to improve the administrative law enforcement level of quality supervision in Guangzhou, to better promote the sound and rapid development of Guangzhou's economy, and to ensure the safety of people's lives and property. Based on the current situation of Guangzhou quality Supervision Bureau, and guided by the service-oriented government and the theory of administration according to law, this paper puts forward the existing problems of Guangzhou quality Supervision Administrative Law Enforcement, including the law enforcement power and the low administrative efficiency. The absence of law enforcement is in conflict with the department, the examination and inspection are unreasonable, the enforcement of the law is difficult, the compulsory measures are unreasonable. The causes of these problems are analyzed, and the main reasons are analyzed in six aspects: the administrative setup needs to be improved, The comprehensive advantages of the law enforcement team are insufficient, some of the situations stipulated by the law are not operable, the internal examination mechanism is unreasonable, the law enforcement environment is not optimized, and the inspection mechanism is unreasonable. On this basis, finally, from improving the quality of the administrative law enforcement team and strengthening the training, Seven aspects, including enriching equipment and improving treatment, reforming examination methods, giving play to social forces, enforcing the law harmoniously by departments, and enhancing publicity, seven aspects are put forward to improve the administrative law enforcement capacity of the Guangzhou quality Supervision Bureau, thereby improving the image of the quality supervision department. Guide the law enforcement personnel to improve their own law enforcement level and service quality, and further improve the effectiveness of the law enforcement and management work of the quality technical supervision department.
