【摘要】:水是生態(tài)環(huán)境的重要組分,是人類生存與發(fā)展不可缺少的生態(tài)資源。在“21世紀(jì)城市水資源國(guó)際學(xué)術(shù)研討會(huì)”上,聯(lián)合國(guó)就把中國(guó)列為世界上13個(gè)最缺水的國(guó)家之一。如何有效保護(hù)和高效利用水資源已成為全球性的時(shí)代課題。論文以湘江流域水資源保護(hù)和高效利用為目標(biāo),設(shè)計(jì)與構(gòu)建水權(quán)交接生態(tài)補(bǔ)償機(jī)制,借助行政權(quán)威和市場(chǎng)效率解決湘江流域的污染與治理問(wèn)題而導(dǎo)致的各種矛盾。促進(jìn)湘江流域產(chǎn)業(yè)結(jié)構(gòu)調(diào)整和加快“經(jīng)濟(jì)升級(jí)版”進(jìn)程,為湘江流域綜合治理提供參考建議。 湘江流域治理效果不佳的根本原因是“行政外部性”和“經(jīng)濟(jì)外部性”疊加而造成“治理失靈”,要解決這兩個(gè)“外部性”,從行政路線解決水權(quán)交接問(wèn)題,從經(jīng)濟(jì)路線解決生態(tài)補(bǔ)償問(wèn)題,建立水權(quán)交接生態(tài)補(bǔ)償機(jī)制,是湘江流域治理的理想選擇。 生態(tài)正義是生態(tài)補(bǔ)償?shù)倪壿嬆繕?biāo),即人類損壞的生態(tài)環(huán)境要得到恢復(fù),所以生態(tài)補(bǔ)償?shù)闹黧w是人,客體是生態(tài)環(huán)境。水權(quán)交接是對(duì)水資源作為公共物品的政府干預(yù)與公共管理,更高效解決代內(nèi)利益、代內(nèi)與代際之間利益的博弈。生態(tài)補(bǔ)償是對(duì)湘江水資源作為經(jīng)濟(jì)資源的成本與收益,在各行政區(qū)找到均衡點(diǎn),達(dá)成水資源的公平而高效利用。因此,論文的理論基礎(chǔ)是生態(tài)正義思想、生態(tài)補(bǔ)償理論與水權(quán)交接理論。 湘江流域在湖南省有著最重要的戰(zhàn)略地位,在水資源開(kāi)發(fā)利用和生態(tài)補(bǔ)償中還存在不少問(wèn)題。在界定水權(quán)交接生態(tài)補(bǔ)償?shù)闹骺腕w的基礎(chǔ)上,針對(duì)湘江特點(diǎn)分析水權(quán)補(bǔ)償標(biāo)準(zhǔn)的指標(biāo)體系、交接點(diǎn)的選擇、補(bǔ)償路線和補(bǔ)償方式的協(xié)調(diào)。改良了湘江流域水足跡計(jì)量模型,以驗(yàn)證和評(píng)估湘江流域水權(quán)交接生態(tài)補(bǔ)償機(jī)制的有效性。在此基礎(chǔ)上提出湘江流域水權(quán)交接生態(tài)補(bǔ)償機(jī)制的配套管理應(yīng)著重落實(shí)水權(quán)交接點(diǎn)管理、生態(tài)補(bǔ)償專項(xiàng)資金管理,強(qiáng)化法制措施和成立湖南湘江流域管理局統(tǒng)一管理。 基于以上研究,得出四個(gè)基本結(jié)論:(1)湘江流域以行政區(qū)劃為單元進(jìn)行綜合治理,建立水權(quán)交接生態(tài)補(bǔ)償機(jī)制是理想選擇;(2)湘江流域水權(quán)生態(tài)補(bǔ)償標(biāo)準(zhǔn)不能完全市場(chǎng)化;(3)水權(quán)交接生態(tài)補(bǔ)償機(jī)制具有一定的推廣適用性;(4)水權(quán)交接生態(tài)補(bǔ)償機(jī)制是一條生態(tài)河流綜合治理的發(fā)展方向;谝陨辖Y(jié)論,本研究的最大價(jià)值與創(chuàng)新在于構(gòu)建了湘江流域水權(quán)交接生態(tài)補(bǔ)償機(jī)制,這同時(shí)也是對(duì)中國(guó)道路理論的開(kāi)拓創(chuàng)新。
[Abstract]:Water is an important component of ecological environment and an indispensable ecological resource for human survival and development. The United Nations has listed China as one of the 13 most water-scarce countries in the world. How to effectively protect and utilize water resources has become a global topic of the times. To design and construct the ecological compensation mechanism of water right transfer, to solve all kinds of contradictions caused by the pollution and treatment problems in Xiangjiang River Basin with the aid of administrative authority and market efficiency, to promote the adjustment of the industrial structure of Xiangjiang River Basin and to speed up the process of "Economic upgrading Edition". To provide reference suggestions for comprehensive management of Xiangjiang River Basin. The fundamental reason for the poor effect of Xiangjiang River Basin management is that the combination of "administrative externality" and "economic externality" results in "governance failure". We should solve these two "externalities" and solve the water rights transfer problem from the administrative route. It is an ideal choice for Xiangjiang river basin to solve the ecological compensation problem from the economic route and establish the ecological compensation mechanism of water right transfer. Ecological justice is the logical goal of ecological compensation, that is, the ecological environment damaged by human beings should be restored, so the main body of ecological compensation is human. The object is the ecological environment. The water right transfer is the government intervention and public management of water resources as public goods, so as to solve the intra-generation interests more efficiently. Ecological compensation is to the cost and benefit of water resources as economic resources in Xiangjiang River, to find the equilibrium point in each administrative region, and to achieve the fair and efficient utilization of water resources. The theoretical basis of the paper is the ecological justice theory, ecological compensation theory and water rights theory. Xiangjiang River Basin has the most important strategic position in Hunan Province, and there are still many problems in the exploitation and utilization of water resources and ecological compensation. According to the characteristics of Xiangjiang River, the index system of water right compensation standard, the choice of junction point, the coordination of compensation route and compensation method are analyzed, and the water footprint measurement model of Xiangjiang river basin is improved. In order to verify and evaluate the effectiveness of ecological compensation mechanism for water right transfer in Xiangjiang river basin, the paper puts forward that the supporting management of ecological compensation mechanism for water right transfer in Xiangjiang river basin should focus on the management of water right junction point and special fund management for ecological compensation. Strengthen legal measures and establish a unified management of Hunan Xiangjiang River Basin Administration. Based on the above study, we draw four basic conclusions: 1) Comprehensive management of the Xiangjiang River basin is based on administrative divisions. It is an ideal choice to establish ecological compensation mechanism for water right transfer. 2) the ecological compensation standard of water right in Xiangjiang river basin can not be completely marketized. 3) the ecological compensation mechanism of water right transfer has certain popularization applicability and the ecological compensation mechanism of water right transfer is as follows:. The development direction of an ecological river comprehensive management. Based on the above conclusion, The greatest value and innovation of this study lies in the construction of ecological compensation mechanism of water right transfer in Xiangjiang river basin, which is also a pioneering innovation of Chinese road theory.
