【摘要】：為了促進(jìn)公路事業(yè)發(fā)展，國家開始在基礎(chǔ)設(shè)施領(lǐng)域引進(jìn)企業(yè)資本，推出“貸款修路，收費(fèi)還貸”政策。公路經(jīng)營企業(yè)通過與政府部門簽訂公路特許經(jīng)營權(quán)合同得以承擔(dān)部分公共管理職能，參與公共產(chǎn)品與服務(wù)的提供。雖然公路事業(yè)因此得到發(fā)展，但也引起諸多收費(fèi)亂象，長期得不到解決。欲解決長期困擾民眾的公路亂收費(fèi)問題，，應(yīng)該從實(shí)際公路收費(fèi)的主體入手，追究公路經(jīng)營企業(yè)亂收費(fèi)的行政法律責(zé)任。對此，本文分為三個部分來論述。第一部分對公路經(jīng)營企業(yè)、收費(fèi)權(quán)及其來源、亂收費(fèi)的表現(xiàn)形式進(jìn)行界定，并且闡述行政法律責(zé)任的歸責(zé)原則與構(gòu)成要件。第二部分指出公路經(jīng)營企業(yè)亂收費(fèi)被追究行政法律責(zé)任的不力情況及原因。第三部分則是針對上述情況所提出的相關(guān)完善建議�？傮w而言，包括完善義務(wù)性規(guī)定和責(zé)任性規(guī)定兩大方面的建議。具體而言，包括公路經(jīng)營企業(yè)應(yīng)承擔(dān)的行政法義務(wù)、責(zé)任追究主體、責(zé)任追究適用的程序以及責(zé)任形式等內(nèi)容。
[Abstract]:In order to promote the development of highway industry, the state began to introduce enterprise capital in the field of infrastructure, and launched a "loan to build roads." The highway management enterprise can undertake part of the public management function by signing the highway franchise contract with the government department. Participation in the provision of public goods and services. Although the road industry has been developed, but also caused a lot of fees chaos, can not be solved for a long time. We should start with the main body of the actual highway toll, and investigate the administrative legal responsibility of the highway management enterprises to collect fees indiscriminately. For this reason, this article is divided into three parts to discuss. The first part is about the highway management enterprises, the right to collect fees and their sources. The manifestation of random charge is defined. The second part points out the weak situation and reasons of the road enterprises' arbitrary charges being investigated for administrative legal liability. The third part is put forward in view of the above situation. Suggestions for improvement. Overall. Including the improvement of obligations and responsibilities of the two aspects of the recommendations. Specifically, including the road management enterprises should bear the obligations of administrative law, accountability of the main body. The procedure and the form of responsibility should be applied.
