我國(guó)社會(huì)中介組織法律規(guī)制研究

【摘要】:社會(huì)中介組織作為連接國(guó)家、市場(chǎng)的第三部門在中國(guó)得到迅猛發(fā)展,承擔(dān)了許多由政府分離出來的公共管理職能,然而,在轉(zhuǎn)型時(shí)期的中國(guó),社會(huì)中介組織發(fā)展不均衡、與政府藕斷絲連、法律地位模糊、責(zé)任難以確定,已經(jīng)嚴(yán)重的制約了社會(huì)中介組織本身的發(fā)展和政府機(jī)構(gòu)的改革;在傳統(tǒng)行政法中社會(huì)中介組織僅僅作為法律法規(guī)授權(quán)或委托的組織的定位,存在著授權(quán)不清、責(zé)任不明、難以訴訟的弊端,根據(jù)公共行政的治理理論,社會(huì)中介組織的權(quán)力來源是行政分權(quán),同時(shí)也是法律的規(guī)定,因而建議我國(guó)借鑒大陸法系的公法人制度,將社會(huì)中介組織作為公法人的—種納入行政法的調(diào)整,使社會(huì)中介組織成為行政主體,當(dāng)社會(huì)中介組織行使公權(quán)力對(duì)其相對(duì)人或其組織成員的權(quán)利造成侵害時(shí),對(duì)社會(huì)中介組織提起行政訴訟是最后也是最有效的手段;通過行政分權(quán),社會(huì)中介組織擁有了公共管理權(quán),但是,公共權(quán)力有擴(kuò)張和濫用的可能,所以要對(duì)社會(huì)中介組織進(jìn)行法律規(guī)制,建議制定社會(huì)中介組織法對(duì)社會(huì)中介組織的設(shè)立條件、法律地位、權(quán)利義務(wù)和責(zé)任作出相應(yīng)的規(guī)定,使社會(huì)中介組織在法治的軌道內(nèi)健康發(fā)展。
[Abstract]:Social intermediary organizations as a link to the country, the third sector of the market in China has been rapid development, has assumed a lot of public management functions separated from the government, however, in the transition period of China. The development of social intermediary organizations is not balanced, and they are connected with the government, the legal status is vague, and the responsibility is difficult to determine, which has seriously restricted the development of social intermediary organizations and the reform of government institutions. In the traditional administrative law, social intermediary organizations are only authorized or entrusted by laws and regulations. There are some disadvantages such as unclear authorization, unclear responsibility and difficulty in litigation, according to the governance theory of public administration. The source of power of social intermediary organizations is administrative decentralization and also the regulation of law. Therefore, it is suggested that our country should draw lessons from the public legal person system of civil law system and bring social intermediary organizations as public legal persons into the adjustment of administrative law. Make the social intermediary organization become the administrative subject, when the social intermediary organization exercises the public power to its opposite party or its organization member's right to cause the infringement. Administrative litigation against social intermediary organizations is the last and most effective means; Through administrative decentralization, social intermediary organizations have the right of public management, but public power has the possibility of expansion and abuse, so it is necessary to regulate the social intermediary organizations by law. It is suggested that the establishment conditions, legal status, rights, obligations and responsibilities of social intermediary organizations should be formulated in order to make the social intermediary organizations develop healthily in the orbit of ruling by law.
