【摘要】：土地有償使用制度是國(guó)家土地資源管理中一個(gè)極其重要的內(nèi)容。2002年,國(guó)土資源部頒布《招標(biāo)拍賣掛牌出讓國(guó)有土地使用權(quán)規(guī)定》,明確規(guī)定:各類經(jīng)營(yíng)性用地,包括商業(yè)、旅游、娛樂和商品住宅等,必須以招標(biāo)、拍賣或者掛牌方式出讓。這是中國(guó)一次重大的"土地革命"。土地招拍掛有效地促進(jìn)了中國(guó)的土地有償使用水平,提高了中國(guó)土地市場(chǎng)的市場(chǎng)化水平,提高了中央政府和地方政府的財(cái)政收入,促進(jìn)了中國(guó)經(jīng)濟(jì)社會(huì)的發(fā)展。當(dāng)前中國(guó)使用最多的土地出讓方式,是掛牌出讓方式。掛牌出讓方式相較招標(biāo)出讓、拍賣出讓兩種方式而言,更加地公正、公開、公平,也更加地透明,能夠有效避免"暗箱"操作,防止和避免腐敗行為的發(fā)生,有利于土地市場(chǎng)的有序競(jìng)爭(zhēng),有利于土地市場(chǎng)的健康發(fā)展。當(dāng)前,我國(guó)城市土地使用權(quán)掛牌出讓總的發(fā)展形勢(shì)是好的,但在實(shí)踐中仍存在著許多亟待解決的深層次問題,這就是本文所要探討的主要內(nèi)容。研究這一問題,有極大的現(xiàn)實(shí)意義和理論意義。本文以土地使用權(quán)掛牌出讓管理制度為主要研究對(duì)象,以珠海市高欄港區(qū)土地掛牌出讓管理模式為實(shí)證研究,對(duì)其中存在的問題進(jìn)行研究和探討。首先從高欄港區(qū)現(xiàn)行土地掛牌工作管理機(jī)制的缺陷入手研究,提出了建立健全管理機(jī)構(gòu)和機(jī)制的對(duì)策;然后從政府與土地市場(chǎng)的關(guān)系方面進(jìn)行研究,提出了政府要加強(qiáng)調(diào)控土地資源,提高土地集約節(jié)約利用水平。政府要以法治精神來加強(qiáng)土地市場(chǎng)的培育;接著研究了高欄港區(qū)現(xiàn)行土地出讓底價(jià)決策方式,提出了完善土地出讓底價(jià)形成機(jī)制的建議;最后從建設(shè)服務(wù)型政府的角度,提出了提高土地掛牌工作的公共服務(wù)水平的對(duì)策。研究的宗旨是將公共管理的思想融入到土地使用權(quán)掛牌出讓管理中,實(shí)現(xiàn)土地資源的合理利用與有效管理。本文的研究成果對(duì)于珠海市高欄港區(qū)制定土地使用權(quán)掛牌出讓戰(zhàn)略具有一定的參考意義,所提出的解決方案具有現(xiàn)實(shí)性和可操作性,這些觀點(diǎn)和結(jié)論對(duì)高欄港區(qū)土地使用權(quán)掛牌出讓工作的發(fā)展會(huì)有所幫助和啟發(fā)。
[Abstract]:The paid use of land system is the management of national land resources in an extremely important content of.2002, the Ministry of land and resources issued the "tender auction listing transferring state-owned land use rights provisions, clearly stipulates: various types of business, including commercial, tourism, entertainment and residential, must be by tender, auction or listing transfer this is a major" China land revolution ". The land auction and effectively promote the level of compensation for the use of Chinese land, improve the level of the market Chinese land market, improve the central government and local government revenue, and promote the development of economy and society. The current China Chinese use most of the land way is the listing to sell. Listing sold compared to tender to sell, auction sold two ways, more fair, open, fair and more transparent, can effectively avoid the" secret" Operation, prevent and avoid the occurrence of corruption, there is conducive to the orderly competition in the land market, is conducive to the healthy development of the land market. At present, listing the general development situation is good in our country city land use rights, but there are still many problems to be solved and the deep-seated problems in practice, this is the main content in this paper to explore. The research of this problem, is of great practical significance and theoretical significance. In this paper, the land use right transfer listed management system as the main research object, in the land of Zhuhai Gaolan Port listing transfer management mode for the empirical research, the research and study of the existing problems. First, from the defects of current land Gaolan Port listing management mechanism study, and puts forward some countermeasures to establish and perfect the management mechanism and mechanism; then studied from the relationship between the government and the land market, the government To strengthen the regulation and control of land resources, improving land intensive use level. The government should strengthen the land market to cultivate the spirit of the rule of law; then study the current land leasing Gaolan Port decision method, put forward to perfect the land reserve price formation mechanism is proposed; finally, from the perspective of building a service-oriented government, put forward some countermeasures to improve the land listing work the level of public service. The research purpose is the public management idea into the land use right transfer listed in the management of sustainable utilization of land resources and effective management. The research results of this paper to develop land use rights listing transfer strategy has certain reference significance for the city of Zhuhai Gaolan Port, the proposed solution has the reality and maneuverability, these views and conclusions for the right to use the Gaolan Port development land listing to sell the work will be of help and Rev.
