【摘要】："函復請示"現(xiàn)象存在的合法合理性,學界爭訟由來已久但未有成論。通過具體分析中央人民政府網(wǎng)站中的公文用例,從"函"文種的適用范圍、辦公廳(室)的機構(gòu)職能兩方面,指出"函復請示"現(xiàn)象的本質(zhì)仍然屬于一種文書"代復"行為。仔細分析"函復請示"現(xiàn)象存在的利弊之后,主張停止此公文用法。同時也考慮到歷史傳承和工作習慣,提出如果保留"函復請示"的用法,那么必須對國家現(xiàn)行文書制度的相關條款進行適當修訂。
[Abstract]:The legal rationality of the existence of "letter and request for instructions" has a long history in academic circles but has not been discussed. By analyzing the use cases of official documents in the website of the Central people's Government, this paper points out that the nature of the phenomenon of "letter and request" is still a kind of act of "acting on behalf" from the two aspects of the scope of application of the "letter" and the functions of the general office (office). After careful analysis of the advantages and disadvantages of the phenomenon of "letter and request", the author proposes to stop the use of this document. At the same time, taking into account the historical heritage and working habits, it is suggested that if the use of "letter and request" is retained, the relevant provisions of the existing national system of instruments must be appropriately revised.
