【摘要】：20世紀(jì)80年代以來,質(zhì)量問題在我國得到了全社會的廣泛重視,但與此同時工程質(zhì)量問題依舊十分突出,因此對提升工程質(zhì)量的研究具有十分重要的現(xiàn)實意義。工程項目是在施工合同的約束下完成建設(shè)的,因此本文從施工合同視角,研究合同中的質(zhì)量條款對我國建設(shè)工程質(zhì)量的影響情況。本文首先介紹了工程質(zhì)量概念、特點(diǎn)以及質(zhì)量管理的相關(guān)理論。在閱讀大量文獻(xiàn)的基礎(chǔ)上,深入研讀我國2013年頒布的《建設(shè)工程施工合同(示范文本)》和國際咨詢工程師聯(lián)合會(FIDIC)1999年編制的《施工合同條件》中質(zhì)量管理相關(guān)條款,歸納施工合同在工程質(zhì)量管理中的作用,以建立施工合同與工程質(zhì)量管理的聯(lián)系。本文的核心內(nèi)容是探討我國2013版《建設(shè)工程施工合同(示范文本)》中質(zhì)量相關(guān)條款對工程質(zhì)量的影響。為此,本文引入FIDIC1999版《施工合同條件》,將兩個合同版本中的質(zhì)量相關(guān)條款進(jìn)行對比,得出差異。在對比中,根據(jù)內(nèi)容將質(zhì)量條款劃分為若干模塊,使比較結(jié)果更加條理清晰。通過對差異進(jìn)行分析,了解我國工程合同范本與國際成熟的合同范本在質(zhì)量條款的設(shè)置上有哪些區(qū)別。本文采用問卷調(diào)查的方法判斷質(zhì)量條款對工程質(zhì)量的影響�；趦蓚�合同版本中的質(zhì)量關(guān)條款差異設(shè)計問卷,采用5級Likert量表測量我國工程建設(shè)領(lǐng)域的管理者對問卷中列舉的質(zhì)量條款的意見。根據(jù)問卷調(diào)查結(jié)果,本文以我國2013版《建設(shè)工程施工合同(示范文本)》的角度提出了針對質(zhì)量條款的修改建議,這些建議以在合同的專用條款中進(jìn)行約定。
[Abstract]:Since the 1980s, the quality problem has been paid more and more attention in the whole society in our country, but at the same time, the engineering quality problem is still very prominent, so the research on improving the engineering quality has very important practical significance. The construction project is completed under the restriction of the construction contract, so this paper studies the influence of the quality clause in the contract on the quality of the construction project in our country from the perspective of the construction contract. This paper first introduces the concept of engineering quality, characteristics and quality management theory. On the basis of reading a large number of documents, this paper makes a thorough study of the construction contract (model text) issued in China in 2013 and the quality management clauses of the Construction contract condition compiled by (FIDIC) in 1999. The function of construction contract in engineering quality management is summarized in order to establish the relation between construction contract and engineering quality management. The core of this paper is to discuss the influence of the quality related clauses in the 2013 edition of China's Construction contract (Model text) on the quality of the project. For this reason, this paper introduces the FIDIC1999 version of Construction contract conditions, and compares the quality related clauses in the two versions of the contract, and obtains the difference. In the comparison, the quality clause is divided into several modules according to the content, which makes the comparison result more coherent and clear. Based on the analysis of the differences, the differences between the quality clauses of the Chinese project contract model and that of the international mature contract model are discussed. This paper uses the method of questionnaire to judge the effect of quality clause on project quality. Based on the quality clause difference design questionnaire between the two contract versions, the opinions of the managers in the field of engineering construction in China on the quality clauses listed in the questionnaire were measured by using the 5-level Likert scale. Based on the results of the questionnaire survey, this paper puts forward some suggestions for the modification of the quality clause from the angle of the 2013 edition of the Construction contract (Model text) of our country, which is agreed in the special clause of the contract.
