【摘要】：在商業(yè)時代,財富大部分由合同構(gòu)成,合同是企業(yè)進行經(jīng)濟活動的重要法律文件,也是產(chǎn)生爭議和糾紛的根源。合同管理是企業(yè)管理的一個核心內(nèi)容,是一個全過程、全方面、科學(xué)的管理。合同履約管理作為合同管理的核心,履約管理的質(zhì)量越來越成為企業(yè)利益保障的重要因素。隨著市場經(jīng)濟、法治經(jīng)濟的深入進行,越來越多的施工企業(yè)因其履約管理不善遭受巨大的損失,加強施工合同履約管理已成為施工企業(yè)的共識。本文首先對建筑工程施工合同履約管理的基礎(chǔ)理論進行了概述,提出施工企業(yè)加強工程施工合同履約管理的必要性。接著將大型施工企業(yè)中交北方公司的履約管理作為研究對象,對該公司的施工合同履約管理現(xiàn)狀、履約管理的主要做法以及初步成效進行了調(diào)查和研究。在詳細調(diào)查研究的基礎(chǔ)上,論文指出了目前中交北方公司合同履約管理遭遇的不利外部影響以及內(nèi)在履約管理存在的問題。最后文章結(jié)合存在的問題,從制度完善、人員培養(yǎng)和選用、合同分析和交底、變更索賠精細化管理、履約過程監(jiān)控、信息化建設(shè)、檔案管理規(guī)范化等七個方面提出了完善的措施。就履約監(jiān)管問題,筆者結(jié)合目前通行的《公路工程施工招標(biāo)文件》的通用條款之規(guī)定,設(shè)計了一套完整的、具有可操作性的履約管理方案,以實現(xiàn)更好地落實履約檢查和管理,提升該企業(yè)的履約管理水平。
[Abstract]:In the commercial era, most of the wealth is composed of contracts, which is an important legal document for enterprises to carry out economic activities, and also the source of disputes and disputes. Contract management is a core content of enterprise management, is a whole process, all aspects, scientific management. Contract performance management is the core of contract management. With the development of the market economy and the economy ruled by law, more and more construction enterprises suffer huge losses because of their poor performance management. It has become the consensus of construction enterprises to strengthen the performance management of construction contracts. In this paper, the basic theory of construction contract performance management is summarized, and the necessity for construction enterprises to strengthen construction contract performance management is put forward. Secondly, the paper takes the performance management of the northern company as the research object, and makes an investigation and research on the present situation of the performance management of the construction contract, the main methods of the performance management and the preliminary results. On the basis of detailed investigation and research, the paper points out the adverse external influence of contract performance management and the problems existing in the internal performance management. Finally, the article combines the existing problems, from the system improvement, personnel training and selection, contract analysis and settlement, change claim fine management, performance process monitoring, information construction, Seven aspects, such as standardization of file management, are put forward to perfect the measures. On the issue of performance supervision, the author designs a set of complete and operable performance management scheme in combination with the provisions of the general terms of "Highway Engineering Construction bidding document" at present, in order to achieve better implementation of performance inspection and management. Improve the performance management of the enterprise.
