【摘要】：隨著城鎮(zhèn)化進程的不斷加速,我國經(jīng)濟持續(xù)快速發(fā)展,城市建設(shè)項目不斷增多。在市場經(jīng)濟背景下,社會進入了轉(zhuǎn)型期,城市發(fā)展面臨著前所未有的復(fù)雜性和矛盾性,城市空間已成為多種利益主體追逐自身價值實現(xiàn)的“競技場”。面對利益主體、建設(shè)活動、社會需求等多元化的背景下,城市規(guī)劃在擁有城市空間資源配置大權(quán)的同時,也一直面臨著來自各種利益主體的沖擊與挑戰(zhàn),困擾著城市規(guī)劃管理部門行政決定以及規(guī)劃自身的有效實施,其最直接的表現(xiàn)形式就是違法建設(shè)行為的瘋狂增長。 本文正是基于以上背景提出了研究的課題,通過閱讀大量英國、澳大利亞、香港的城鄉(xiāng)規(guī)劃的法規(guī)文獻資料,整體的引介英國、澳大利亞、香港的規(guī)劃控制中強制執(zhí)行的法律依據(jù)、執(zhí)行主體、執(zhí)行對象、條款細則、執(zhí)行程序等內(nèi)容,結(jié)合我國規(guī)劃體系以及幾個典型的強制執(zhí)行案例進行深入的對比分析,提出完善我國城市規(guī)劃體系中強制執(zhí)行的策略。 我國目前具備了建立城市規(guī)劃體系中強制執(zhí)行的必要性,但尚未形成完整的體系,以落實到城市規(guī)劃實施管理過程中。完善規(guī)劃體系中的強制執(zhí)行,關(guān)鍵在于以下兩個層面的確立： ·法律法規(guī)體系層面的完善——在法律法規(guī)體系中,明確違法建設(shè)的法律界定、刑事責(zé)任、違法建設(shè)的豁免機制等相關(guān)的規(guī)定,使得行政機構(gòu)和司法機構(gòu)能夠有針對性的作出符合法律法規(guī)要求的行政決定和法律判決,在執(zhí)行過程中明確立法的思想和原則,充分發(fā)揮自由裁量的優(yōu)勢,使得公平正義和行政效率之間到達一個有效的平衡。 ·運作程序?qū)用娴耐晟啤趯嵺`層面,全方位的架構(gòu)強制執(zhí)行的司法機構(gòu)和司法程序,充分發(fā)揮司法程序的特點,確保執(zhí)行程序的公平正義。并通過豐富強制執(zhí)行的措施來保證強制執(zhí)行能夠得到順利地實施,有效地避免因暴力執(zhí)行而造成的社會矛盾以及環(huán)境破壞等問題。 在沒有統(tǒng)一立法的基礎(chǔ)上建立起來的規(guī)劃體系中的強制執(zhí)行,自然會面臨很多困境,本文也試圖提出一些廣泛意義上的改善建議去解決難題。通過強制執(zhí)行制度的完善,增強規(guī)劃控制機制的有效性,確保公眾對規(guī)劃體系的持續(xù)支持和信任。
[Abstract]:With the acceleration of urbanization process, China's economy continues to develop rapidly, urban construction projects continue to increase. Under the market economy background, the society has entered the transition period, the city development is facing the unprecedented complexity and the contradiction, the city space has already become the "arena" which many kinds of benefit main bodies pursue their own value realization. In the face of diversified interests, construction activities and social needs, urban planning, while having the power to allocate urban space resources, has always been faced with the impact and challenges from all kinds of stakeholders. The administrative decision of urban planning management department and the effective implementation of planning itself are perplexed, the most direct form of which is the crazy growth of illegal construction behavior. Based on the above background, this paper puts forward the research topics, through reading a large number of UK, Australia, Hong Kong urban and rural planning laws and documents, the overall introduction of the United Kingdom, Australia, The legal basis of enforcement in planning control in Hong Kong, the subject of execution, the object of execution, the terms and conditions, the execution procedure, and so on, are compared and analyzed in depth in combination with the planning system of our country and several typical cases of enforcement. This paper puts forward the strategies to perfect the enforcement in the urban planning system of our country. At present, China has the necessity to establish the compulsory execution in the urban planning system, but it has not yet formed a complete system to carry out the process of urban planning implementation and management. The key to improve the enforcement of the planning system lies in the establishment of the following two levels: the perfection of the legal system of laws and regulations-in the system of laws and regulations, a clear legal definition of illegal construction, criminal responsibility, Relevant provisions such as exemption mechanisms for illegal construction enable administrative and judicial organs to make targeted administrative decisions and legal decisions that meet the requirements of laws and regulations, and to clarify the ideas and principles of legislation in the course of implementation. Give full play to the advantages of discretion, so as to achieve an effective balance between fairness, justice and administrative efficiency. A comprehensive framework of enforcement of the judiciary and judicial procedures to give full play to the characteristics of judicial procedures to ensure the implementation of fair and just procedures. And through abundant enforcement measures to ensure that the enforcement can be carried out smoothly, effectively avoid the social conflicts caused by violence and environmental damage and other problems. The compulsory execution in the planning system established on the basis of the lack of unified legislation will naturally face many difficulties. This paper also tries to put forward some suggestions for improvement in a wide sense to solve the difficult problems. Through the improvement of the enforcement system, the effectiveness of the planning control mechanism is enhanced to ensure the continuous support and trust of the public to the planning system.
