【摘要】：目前,中國工程企業(yè)響應(yīng)“走出去”的號召,逐步增加了對外工程的承包,使得對外承包已經(jīng)成為“走出去”戰(zhàn)略的主要形式。對外承包的增加能夠釋放國內(nèi)多余的工程產(chǎn)能,向國外輸出勞務(wù)、技術(shù)、設(shè)備,增加相互之間的交流,提高中國的綜合實力。但與此同時,國際工程承包商也面臨著很多問題。國際工程由于其規(guī)模大、建設(shè)周期長、參與方多、國際環(huán)境復(fù)雜等特點,使得中國承包商面臨著頻繁的爭議,學(xué)術(shù)界也缺少對國際工程承包商在爭議解決方式?jīng)Q策上的研究,因此如何在爭議解決方式上進行適當(dāng)?shù)臎Q策成為重要問題。本文首先通過文獻分析和專家訪談確定了國際工程爭議解決方式和決策時的評價目標(biāo),分為3種解決方式和7個評價目標(biāo)。然后通過對國際工程承包商進行問卷調(diào)查獲得關(guān)于國際工程爭議解決方式?jīng)Q策的相關(guān)數(shù)據(jù),利用多目標(biāo)模糊決策法建立基于承包商視角的國際工程爭議解決方式選擇模型。本文根據(jù)調(diào)查數(shù)據(jù),利用已建立的多目標(biāo)決策模型,分析中國國際工程承包商在爭議解決方式上的決策,最終得出爭議解決方式的優(yōu)先次序是協(xié)商、爭議解決替代方式、仲裁或訴訟,中國國際工程承包商在爭議進行到優(yōu)選的解決方式時盡量與對方達成一致意見,從而更能滿足自身的需求。本文建立的爭議解決方式?jīng)Q策模型和分析中國國際工程承包商的優(yōu)選方式為國際工程承包商的決策提供了支持和指導(dǎo)。
[Abstract]:At present, in response to the call of "going out", Chinese engineering enterprises have gradually increased the contracting of foreign projects, making it the main form of "going out" strategy. The increase of foreign contracting can release the redundant engineering capacity in China, export labor, technology and equipment to foreign countries, increase the exchange between each other, and improve China's comprehensive strength. But at the same time, international engineering contractors are also facing a lot of problems. Because of its large scale, long construction period, more participants and complex international environment, Chinese contractors are facing frequent disputes, and the academic circles lack of research on the decision-making of international engineering contractors' dispute resolution. Therefore, how to make appropriate decisions on dispute settlement has become an important issue. In this paper, through literature analysis and expert interviews, the evaluation objectives of international engineering dispute resolution and decision-making are determined, which are divided into three solutions and seven evaluation objectives. Then through the questionnaire survey to the international engineering contractors to obtain the relevant data about the decision of international engineering dispute resolution method, the multi-objective fuzzy decision method is used to establish the model of the international engineering dispute settlement mode selection based on the contractor's perspective. Based on the survey data and using the established multi-objective decision model, this paper analyzes the decision of Chinese international engineering contractors in dispute settlement, and finally concludes that the priority of dispute resolution is negotiation and alternative dispute resolution. Arbitration or litigation, China's international engineering contractor in the dispute on the preferred way to reach agreement with the other party, so as to better meet their own needs. In this paper, the decision model of dispute resolution and the analysis of the optimal selection of Chinese international engineering contractors provide support and guidance for the decision-making of international engineering contractors.
