建設(shè)工程合同管理若干問題研究

【摘要】:一個工程項(xiàng)目從立項(xiàng)到投入使用,尤其是大中型項(xiàng)目,要經(jīng)歷十分復(fù)雜的過程。項(xiàng)目參建單位和協(xié)建單位眾多,通常涉及業(yè)主、勘察設(shè)計(jì)單位、監(jiān)理單位、工程總包單位、工程分包單位、材料設(shè)備供應(yīng)單位等,各方面責(zé)任界限的劃分、合同權(quán)利和義務(wù)的規(guī)定非常復(fù)雜。在這些復(fù)雜的權(quán)利義務(wù)體系中,合同及相關(guān)合同文件是唯一的載體,因此管理好合同是一項(xiàng)復(fù)雜、全面的系統(tǒng)工程,是從合同條件的擬訂、協(xié)商、簽訂、履行、變更、索賠等情況的檢查和分析著手進(jìn)行的科學(xué)化、規(guī)范化、系統(tǒng)化的管理工作。通過實(shí)行對合同的正確管理,,實(shí)現(xiàn)建筑工程質(zhì)量、投資、進(jìn)度的預(yù)控目標(biāo)。雖然目前我國的建設(shè)工程合同管理體系日漸規(guī)范,管理水平也在不斷提高,但與國際先進(jìn)水平相比還存在一定差距。本文引入多個案例進(jìn)行分析,著重研究合同簽約管理、情勢變更、合理調(diào)價、工期索賠、爭議評審解決等合同管理制度中的若干問題。通過研究提出相應(yīng)方法措施完善合同管理中的一些不足,使得合同更加注重對發(fā)包人、承包人市場行為的引導(dǎo)、規(guī)范和權(quán)益平衡,使與現(xiàn)行法律和其他法律文本更加銜接,保證合同的適用性,促進(jìn)形成良性交易習(xí)慣,有效遏制常見違法違規(guī)現(xiàn)象,維護(hù)合同當(dāng)事人的合法權(quán)益,為推動建筑市場健康良性發(fā)展起到一些借鑒。
[Abstract]:A project from project establishment to put into use, especially large and medium projects, has to go through a very complex process.There are many participating units and co-construction units, usually involving owners, survey and design units, supervision units, general engineering contracting units, subcontracting units, material and equipment supply units, and the division of responsibility boundaries in all aspects,Contractual rights and obligations are complicated.In these complex systems of rights and obligations, the contract and related contract documents are the only carrier, so managing the contract is a complex and comprehensive system engineering, from the drafting, negotiation, signing, performance and modification of the contract conditions,Scientific, standardized and systematic management of claims, etc.Through the implementation of the correct management of the contract, to achieve the construction quality, investment, progress of the pre-control objectives.Although the management system of construction project contract in our country is becoming more and more standardized and the management level is improving continuously, there is still a certain gap compared with the international advanced level.In this paper, several cases are introduced to analyze some problems in contract management system, such as contract signing management, situation change, reasonable price adjustment, time limit claim, dispute evaluation and resolution, etc.Through the research, the author puts forward the corresponding methods and measures to perfect some deficiencies in contract management, which makes the contract pay more attention to guide, standardize and balance the market behavior of the contractor and the contractor, and make the contract more connected with the current law and other legal texts.Guarantee the applicability of the contract, promote the formation of benign trading habits, effectively curb common violations and regulations, protect the legitimate rights and interests of the parties to the contract, and promote the healthy development of the construction market to play some reference.
