【摘要】：近年來(lái),我國(guó)私募股權(quán)投資基金取得了長(zhǎng)足的發(fā)展,但仍處在初級(jí)發(fā)展階段。我國(guó)私募股權(quán)投資基金由于發(fā)展時(shí)間短,配套法律法規(guī)不健全,對(duì)私募股權(quán)基金行業(yè)的發(fā)展形成了嚴(yán)重制約。本文立足于中國(guó)立法現(xiàn)狀,從明確監(jiān)管機(jī)構(gòu)職能,制定專門的PE法規(guī),加強(qiáng)基金管理機(jī)構(gòu)監(jiān)管,加強(qiáng)基金投資人監(jiān)管,加強(qiáng)基金業(yè)務(wù)監(jiān)管五個(gè)角度提出立法完善對(duì)策。
[Abstract]:In recent years, private equity funds in China have made considerable progress, but they are still in the primary stage of development. Due to the short development time and imperfect supporting laws and regulations, private equity investment funds in China have formed serious constraints on the development of private equity fund industry. Based on the present situation of legislation in China, this paper puts forward some countermeasures from five angles: defining the functions of regulatory institutions, formulating special PE laws and regulations, strengthening the supervision of fund management institutions, strengthening the supervision of fund investors, and strengthening the supervision of fund business.
