【摘要】：隨著創(chuàng)業(yè)板及股指期貨的相繼推出,"投資者適當(dāng)性"逐漸成為中國(guó)證券投資者保護(hù)制度中的一項(xiàng)重要內(nèi)容。在資本市場(chǎng)全球化發(fā)展背景下,為運(yùn)用投資者適當(dāng)性規(guī)則實(shí)現(xiàn)投資者教育和保護(hù)的目標(biāo),有必要詳盡地介紹此項(xiàng)制度在域外的發(fā)展及對(duì)金融行業(yè)產(chǎn)生的重要影響。由于歐盟投資者適當(dāng)性制度發(fā)展受先前法律的影響較少,內(nèi)容更為全面且徹底,因而對(duì)中國(guó)資本市場(chǎng)投資者保護(hù)規(guī)則的完善具有更為重要的現(xiàn)實(shí)意義。本文將對(duì)歐盟《金融工具市場(chǎng)指令》及其執(zhí)行指令中的相關(guān)內(nèi)容進(jìn)行逐一介紹、分析,以供完善中國(guó)證券投資者保護(hù)機(jī)制借鑒。
[Abstract]:With the introduction of the GEM and the stock index futures, the "Investor's appropriateness" has become an important part of China's securities investor protection system. In the background of the globalization of capital market, in order to realize the goal of investor education and protection by using the appropriate rules of investors, it is necessary to introduce the development of the system and the important influence on the financial industry in detail. Because the development of the proper system of the EU investor is less influenced by the previous law, the content is more comprehensive and thorough, so it is of great practical significance to the improvement of the investor protection rule of the Chinese capital market. This paper will introduce and analyze the relevant contents of the EU and its execution order to improve the protection mechanism of China's securities investors.
