【摘要】：美國(guó)金融改革法案所帶來(lái)的希冀與期待,似乎已將此次金融危機(jī)的陰影漸漸驅(qū)散,其間"危險(xiǎn)"如何積聚、爆發(fā),監(jiān)管者如何反思、應(yīng)對(duì)從而將其轉(zhuǎn)化為制度突破的"機(jī)遇",為我們提供了觀察和校驗(yàn)金融法治的典型范本:金融業(yè)務(wù)的原理在于將資產(chǎn)轉(zhuǎn)化為資本,而逐利動(dòng)機(jī)下的金融操作會(huì)使得資本過(guò)度偏離資產(chǎn),造成風(fēng)險(xiǎn)累積,只有深化金融監(jiān)管的專業(yè)性,加強(qiáng)中介機(jī)構(gòu)的誠(chéng)信建設(shè),倚重投資者的市場(chǎng)監(jiān)督能力,才能構(gòu)建起有效的危機(jī)防范機(jī)制,從而加強(qiáng)和完善金融法治建設(shè)。
[Abstract]:The hopes and expectations brought about by the US Financial Reform Act seem to have gradually dispelled the shadow of the financial crisis, in which "danger" accumulates and erupts, and regulators reflect on how to deal with it and thus turn it into an "opportunity" for institutional breakthroughs. It provides us with a typical model for observing and verifying the financial rule of law: the principle of financial business is to convert assets into capital, and the financial operation under profit motive will cause excessive deviation of capital from assets, resulting in risk accumulation. Only by deepening the professionalism of financial supervision, strengthening the credit construction of intermediary organizations and relying on the market supervision ability of investors, can we construct an effective crisis prevention mechanism and strengthen and perfect the construction of financial rule by law.
