后危機(jī)時(shí)代中國(guó)金融監(jiān)管制度改革思考

【摘要】:在全球經(jīng)濟(jì)一體化的推動(dòng)下,國(guó)際全融業(yè)處于新的改革浪潮中,這使金融監(jiān)管面臨更嚴(yán)峻的挑戰(zhàn)。自2007年起,美國(guó)的次級(jí)債在全世界范圍內(nèi)所引發(fā)的金融危機(jī),無(wú)疑對(duì)各個(gè)國(guó)家的金融監(jiān)管體系都是一次極大的沖擊。國(guó)際社會(huì)從加強(qiáng)國(guó)際金融監(jiān)管合作,加強(qiáng)金融衍生工具監(jiān)管等角度,做出了深入的探索以及反思,并獲得了新的突破和進(jìn)展。金融危機(jī)給我國(guó)造成的影響延續(xù)至今,怎樣對(duì)國(guó)際先進(jìn)成功的經(jīng)驗(yàn)及成果進(jìn)行借鑒,實(shí)現(xiàn)國(guó)內(nèi)金融監(jiān)管體制的改革及完善,保證我國(guó)金融安全性穩(wěn)定運(yùn)行,以國(guó)際金融監(jiān)管發(fā)展趨勢(shì)、方向及原則為參照,實(shí)現(xiàn)我國(guó)的經(jīng)濟(jì)和金融在世界經(jīng)濟(jì)一體化中占有一席之地,這也是目前我國(guó)金融業(yè)亟需解決的問(wèn)題。 金融監(jiān)管是指金融主管機(jī)關(guān)依據(jù)國(guó)家法律規(guī)定對(duì)整個(gè)金融業(yè)實(shí)施的監(jiān)督管理,,目的是防范金融風(fēng)險(xiǎn),維護(hù)金融體系的穩(wěn)健運(yùn)行。金融監(jiān)管以公共利益理論、保護(hù)債權(quán)論、金融風(fēng)險(xiǎn)控制論為主要理論基礎(chǔ)。本次全球性金融危機(jī)爆發(fā)后,暴露出了金融監(jiān)管在宏觀審慎性監(jiān)管、逆周期監(jiān)管、信用評(píng)級(jí)監(jiān)管、影子銀行監(jiān)管以及金融消費(fèi)者利益保護(hù)等問(wèn)題和缺陷。各國(guó)針對(duì)這些問(wèn)題和缺陷進(jìn)行了深刻反思相應(yīng)改革。其中,美國(guó)頒布了《美國(guó)金融監(jiān)管改革計(jì)劃》等法案,以法律手段確立了改革方式;英國(guó)的監(jiān)管改革除了頒布了一系列的法案條例外,建立了新的監(jiān)管框架,強(qiáng)調(diào)了系統(tǒng)性風(fēng)險(xiǎn)的監(jiān)管;歐盟的改革是成立了歐盟系統(tǒng)風(fēng)險(xiǎn)委員會(huì)、建立歐盟金融監(jiān)管系統(tǒng)等,致力于協(xié)調(diào)各成員國(guó)監(jiān)管主體之間的合作;日本的監(jiān)管改革包括頒布金融監(jiān)管改革方案、增加保險(xiǎn)監(jiān)管內(nèi)容等。中國(guó)金融業(yè)在本次危機(jī)中雖然未受到嚴(yán)重波及,但金融監(jiān)管存在的問(wèn)題逐漸顯現(xiàn),其中包括金融監(jiān)管法律不健全、宏觀審慎性框架不完善、監(jiān)管協(xié)調(diào)機(jī)制缺陷等。借鑒發(fā)達(dá)國(guó)家金融監(jiān)管改革的經(jīng)驗(yàn)和啟示,針對(duì)中國(guó)金融監(jiān)管暴露的問(wèn)題,在后危機(jī)時(shí)代,應(yīng)從更新金融監(jiān)管理念、完善金融監(jiān)管體系與機(jī)制建設(shè)、建立具有特色金融消費(fèi)者保護(hù)機(jī)制、妥善處理金融創(chuàng)新與監(jiān)管的關(guān)系、加強(qiáng)國(guó)際間的金融監(jiān)管合作等方面對(duì)中國(guó)金融監(jiān)管制度進(jìn)行改革與完善。
[Abstract]:With the promotion of global economic integration, the international financial industry is in a new wave of reform, which makes financial supervision face more serious challenges. Since 2007, the financial crisis caused by the United States subprime debt in the world is undoubtedly a great impact on the financial regulatory system of every country. From the angles of strengthening international financial supervision and cooperation and strengthening the supervision of financial derivatives, the international community has made a deep exploration and introspection, and has made new breakthroughs and progress. The impact of the financial crisis on our country continues up to now. How to draw lessons from the international advanced and successful experience and achievements, to realize the reform and perfection of domestic financial supervision system, and to ensure the stable operation of financial security in our country. According to the development trend, direction and principle of international financial supervision, China's economy and finance have a place in the world economic integration, which is also the problem that our financial industry needs to solve. Financial supervision refers to the supervision and management of the whole financial industry carried out by the competent financial authorities according to the national laws. The purpose is to guard against financial risks and to maintain the steady operation of the financial system. Financial supervision is based on the theory of public interest, the theory of protecting creditor's rights and the theory of financial risk control. After the global financial crisis broke out, it exposed the problems and defects of financial supervision in macro-prudential supervision, counter-cyclical supervision, credit rating supervision, shadow banking supervision and the protection of the interests of financial consumers. Various countries have carried on profound reflection on the corresponding reform in view of these problems and shortcomings. Among them, the United States promulgated "the United States Financial Supervision Reform Plan" and other bills, legal means to establish the way of reform; In addition to a series of regulations, the British regulatory reform has established a new regulatory framework, emphasizing the regulation of systemic risk; The reform of the European Union is the establishment of the European Union systemic risk Committee, the establishment of the European Union financial regulatory system and so on, committed to coordinate the cooperation between the various member States. Japan's regulatory reform includes the promulgation of financial regulatory reform plan, the addition of insurance regulatory content. Although China's financial industry has not been seriously affected in this crisis, the existing problems of financial supervision have gradually appeared, including imperfect financial supervision laws, imperfect macro-prudential framework, and defects of regulatory coordination mechanism. Drawing lessons from the experience and enlightenment of the financial supervision reform in developed countries, aiming at the problems exposed to the financial supervision in China, in the post-crisis era, we should renew the concept of financial supervision and perfect the financial supervision system and mechanism construction. To establish a special financial consumer protection mechanism, properly handle the relationship between financial innovation and supervision, and strengthen international financial regulatory cooperation to reform and improve China's financial regulatory system.
