我國商業(yè)銀行個(gè)人理財(cái)業(yè)務(wù)法律風(fēng)險(xiǎn)及其防范研究

【摘要】:商業(yè)銀行個(gè)人理財(cái)業(yè)務(wù)在屬性上應(yīng)當(dāng)劃歸商業(yè)銀行的中間業(yè)務(wù),是商業(yè)銀行在傳統(tǒng)銀行業(yè)務(wù)盈利能力下降的情況下,面對(duì)生存和市場競爭的雙重壓力下所進(jìn)行的零售銀行業(yè)務(wù)的創(chuàng)新。商業(yè)銀行個(gè)人理財(cái)業(yè)務(wù)不僅能使商業(yè)銀行穩(wěn)定客戶基礎(chǔ),提高商業(yè)銀行的競爭實(shí)力,也能實(shí)現(xiàn)居民個(gè)人及家庭資產(chǎn)的保值增值。但不容忽視的是,商業(yè)銀行在開展此項(xiàng)業(yè)務(wù)過程中面臨的法律風(fēng)險(xiǎn)成為制約其發(fā)展的主要瓶頸。但是商業(yè)銀行在開展此項(xiàng)業(yè)務(wù)過程中面臨的法律風(fēng)險(xiǎn)已成為其發(fā)展道路上的一大障礙。論文以商業(yè)銀行個(gè)人理財(cái)業(yè)務(wù)的基礎(chǔ)理論為切入點(diǎn),針對(duì)我國商業(yè)銀行個(gè)人理財(cái)業(yè)務(wù)在市場準(zhǔn)入、產(chǎn)品開發(fā)設(shè)計(jì)、產(chǎn)品宣傳銷售以及產(chǎn)品售后等環(huán)節(jié)存在的法律風(fēng)險(xiǎn),,深入探析了我國商業(yè)銀行個(gè)人理財(cái)業(yè)務(wù)法律風(fēng)險(xiǎn)的成因;在借鑒發(fā)達(dá)國家和地區(qū)商業(yè)銀行個(gè)人理財(cái)業(yè)務(wù)法律風(fēng)險(xiǎn)防范對(duì)策的基礎(chǔ)上,提出我國商業(yè)銀行個(gè)人理財(cái)業(yè)務(wù)法律風(fēng)險(xiǎn)的防范之道在于針對(duì)法律風(fēng)險(xiǎn)的成因采取相應(yīng)的對(duì)策。
[Abstract]:The commercial bank's personal financial management business should be classified as the intermediary business of the commercial bank in terms of its attribute. It is the case that the commercial bank's profitability of the traditional banking business is declining, The innovation of retail banking business under the double pressure of survival and market competition. The personal financial business of commercial banks can not only stabilize the customer base of commercial banks, improve the competitive strength of commercial banks, but also maintain and increase the value of personal and household assets. However, it can not be ignored that the legal risks faced by commercial banks in the process of carrying out this business become the main bottleneck restricting their development. However, the legal risks faced by commercial banks in the course of carrying out this business have become a major obstacle to their development. Based on the basic theory of personal finance business of commercial banks, this paper aims at the legal risks in market access, product development and design, product promotion and sales, and after sale of products in China's commercial banks. This paper probes into the causes of the legal risk of personal financial management business of commercial banks in China, and on the basis of drawing lessons from the legal risk prevention measures of personal financial management business of commercial banks in developed countries and regions, This paper puts forward that the prevention of the legal risk of personal financial management of commercial banks in China lies in taking corresponding countermeasures against the causes of legal risks.
