【摘要】：通過分析現(xiàn)行法律框架下中國金融監(jiān)管協(xié)調(diào)合作的必要性,梳理和總結(jié)協(xié)調(diào)合作取得的成效后發(fā)現(xiàn),當(dāng)前金融監(jiān)管協(xié)調(diào)中主要存在牽頭人地位不明確、協(xié)調(diào)機制對監(jiān)管機構(gòu)約束力不強、缺乏有效的爭議解決機制和監(jiān)督機制、影子銀行體系游離于金融監(jiān)管之外、監(jiān)管協(xié)調(diào)機制缺乏匹配的專業(yè)人才等問題。建議明確央行作為金融監(jiān)管協(xié)調(diào)機制牽頭人的地位,進(jìn)一步完善金融聯(lián)席會議制度,建立金融監(jiān)管協(xié)調(diào)監(jiān)督機制,積極培養(yǎng)綜合型監(jiān)管人才;強調(diào)金融監(jiān)管協(xié)調(diào)機制應(yīng)注重服務(wù)金融市場、監(jiān)管對象和投資者。
[Abstract]:By analyzing the necessity of the coordination and cooperation of financial supervision in China under the current legal framework, it is found that the status of the leading person in the coordination of financial supervision is not clear, after combing and summing up the results of the coordination and cooperation. The coordination mechanism is not strong to the supervision institution, lacks the effective dispute resolution mechanism and the supervision mechanism, the shadow banking system dissociates from the financial supervision, the supervision coordination mechanism lacks the matching professional personnel and so on. It is suggested that the central bank should clarify the position of the central bank as the leader of the financial supervision coordination mechanism, further improve the financial joint meeting system, establish the financial supervision coordination and supervision mechanism, and actively train the comprehensive supervisory talents. It is emphasized that the coordination mechanism of financial supervision should pay attention to serving financial market, supervising object and investors.
