【摘要】：網(wǎng)絡(luò)銀行的產(chǎn)生和迅速發(fā)展給傳統(tǒng)金融業(yè)帶來了沖擊,其業(yè)務(wù)風(fēng)險(xiǎn)所呈現(xiàn)出的新特點(diǎn)使傳統(tǒng)銀行監(jiān)管體系陷入了監(jiān)管乏力的困境。我國(guó)應(yīng)借鑒國(guó)際上較具代表性的網(wǎng)絡(luò)銀行風(fēng)險(xiǎn)法律規(guī)制模式,從加強(qiáng)對(duì)網(wǎng)絡(luò)銀行的全面監(jiān)管、制定網(wǎng)絡(luò)銀行消費(fèi)者合法權(quán)益保護(hù)制度、加強(qiáng)對(duì)跨國(guó)網(wǎng)絡(luò)銀行的管理等方面構(gòu)建多層次的網(wǎng)絡(luò)銀行法律制度,為有效防范網(wǎng)絡(luò)銀行業(yè)務(wù)風(fēng)險(xiǎn)、促進(jìn)網(wǎng)絡(luò)銀行健康發(fā)展提供法制保障。
[Abstract]:The emergence and rapid development of the network bank has brought impact to the traditional financial industry, and the new characteristics of its business risk make the traditional banking supervision system fall into the predicament of weak supervision. Our country should draw lessons from the international representative legal regulation mode of network bank risk, strengthen the overall supervision of network bank, and formulate the legal rights and interests protection system of network bank consumer. To strengthen the management of transnational network banks and other aspects, to build a multi-level network banking legal system, to effectively prevent network banking business risks, promote the healthy development of network banks to provide legal protection.
