我國(guó)民間借貸監(jiān)管制度研究

【摘要】:近年來,隨著我國(guó)民間借貸的持續(xù)活躍和規(guī)模的不斷擴(kuò)大,民間借貸問題成為金融、法律界乃至全社會(huì)討論的熱門話題。民間借貸對(duì)經(jīng)濟(jì)發(fā)展既有積極作用,也有消極影響,因此如何對(duì)民間借貸進(jìn)行有效監(jiān)管,使民間借貸更能適應(yīng)經(jīng)濟(jì)發(fā)展對(duì)資本的需求,已經(jīng)成為亟待解決的現(xiàn)實(shí)問題。 本文首先闡述了我國(guó)民間借貸的基本理論和問題,從民間借貸的法律概念、法律特征及種類等方面對(duì)民間借貸進(jìn)行了界定,分析了民間借貸的形成原因以揭示民間借貸存在的客觀性,并通過對(duì)民間借貸的積極作用和消極影響進(jìn)行分析,論證了民間借貸監(jiān)管的必要性。然后,在以上分析的基礎(chǔ)上,考察了我國(guó)民間借貸監(jiān)管制度的現(xiàn)狀,從而分析出監(jiān)管制度的缺陷所在。最后,通過對(duì)域外民間借貸監(jiān)管制度的考察,總結(jié)域外監(jiān)管經(jīng)驗(yàn)的共性方面,并針對(duì)我國(guó)民間借貸監(jiān)管制度的缺陷,有的放矢地提出了完善我國(guó)民間借貸監(jiān)管制度的思路和法律建議。 我國(guó)民間借貸監(jiān)管思路的核心是選擇適當(dāng)?shù)谋O(jiān)管路徑和監(jiān)管模式,本文認(rèn)為監(jiān)管路徑應(yīng)當(dāng)是民間借貸的法制化,即在制定民間借貸法律時(shí)就應(yīng)當(dāng)考量對(duì)合法民間借貸的肯定和對(duì)非法民間借貸的遏制。民間借貸監(jiān)管的模式應(yīng)選擇分類監(jiān)管和重點(diǎn)監(jiān)管的模式,即以營(yíng)利性為特征將民間借貸進(jìn)行分類并分別進(jìn)行監(jiān)管,對(duì)其中的商事性借貸進(jìn)行重點(diǎn)監(jiān)管。民間借貸監(jiān)管的法律建議應(yīng)側(cè)重對(duì)民間借貸的積極作用進(jìn)行規(guī)范引導(dǎo),,同時(shí)對(duì)民間借貸的消極影響進(jìn)行遏制,這可以通過修改現(xiàn)行法律法規(guī)和制定專門性民間借貸法律《放貸人條例》對(duì)其進(jìn)行規(guī)制。因?yàn)槔碚摻绾蛯?shí)務(wù)界在《放貸人條例》制定過程中還存在許多爭(zhēng)議,所以本文希望對(duì)爭(zhēng)議焦點(diǎn)問題做一些有意義的探討。
[Abstract]:In recent years, with the continuous active and expanding scale of private lending in China, the issue of private lending has become a hot topic in finance, law and even the whole society. Private lending has both positive and negative effects on economic development, so how to effectively supervise private lending and make it more adaptable to the demand for capital in economic development has become a practical problem to be solved urgently. This paper first expounds the basic theory and problems of folk lending in China, and defines it from the aspects of the legal concept, legal characteristics and types of folk lending. In order to reveal the objectivity of the existence of folk lending, this paper analyzes the reasons for the formation of private lending, and demonstrates the necessity of the supervision of private lending through the analysis of the positive and negative effects of private lending. Then, on the basis of the above analysis, this paper investigates the present situation of the private loan supervision system in China, and then analyzes the defects of the supervision system. Finally, through the investigation of the foreign private loan supervision system, the paper summarizes the common aspects of the extraterritorial supervision experience, and aims at the defects of our country's private loan supervision system. The author puts forward some ideas and legal suggestions to perfect the supervision system of non-government loan. The core of our country's private loan supervision is to choose the proper supervision path and supervision mode. This paper holds that the supervision path should be the legalization of private lending. That is, we should consider the affirmation of legal private lending and the suppression of illegal private lending. The mode of private loan supervision should choose the classified supervision and the key supervision mode, that is to say, the private loan should be classified and supervised separately with the feature of profit, and the commercial loan should be supervised emphatically. The legal advice of private lending supervision should focus on regulating and guiding the positive role of private lending and at the same time containing the negative effects of private lending. This can be regulated by amending existing laws and regulations and enacting specialized private lending laws and regulations. Because there are still many controversies in the process of making the "lender's regulations" in the theoretical and practical circles, this paper hopes to make some meaningful discussions on the focus of the controversy.
