伊斯蘭金融監(jiān)管模式與我國的選擇

【摘要】:近些年伊斯蘭金融業(yè)在全球范圍內(nèi)迅速發(fā)展,對全球范圍內(nèi)發(fā)展伊斯蘭金融業(yè)國家都會面臨著一系列的監(jiān)管問題,包括監(jiān)管當(dāng)局面臨著應(yīng)當(dāng)對伊斯蘭金融業(yè)進(jìn)行單獨監(jiān)管還是將其納入傳統(tǒng)監(jiān)管體系的問題、應(yīng)當(dāng)如何對伊斯蘭金融業(yè)實施審慎監(jiān)管的問題、是否應(yīng)當(dāng)對沙里亞相適性進(jìn)行監(jiān)管以及如何對沙里亞相適性進(jìn)行監(jiān)管、修改現(xiàn)行法律還是單獨立法的問題等。文中選取了馬來西亞、巴林、迪拜國際金融中心、英國和巴基斯坦等5個國家和地區(qū),以各國采取分業(yè)/混業(yè)監(jiān)管模式、將伊斯蘭金融業(yè)納入傳統(tǒng)監(jiān)管體系/單獨監(jiān)管、是否單獨制定了伊斯蘭金融相關(guān)法律以及監(jiān)管機(jī)構(gòu)是否在其機(jī)構(gòu)內(nèi)設(shè)立沙里亞委員會作為指標(biāo)對其伊斯蘭金融業(yè)的監(jiān)管進(jìn)行了分析和比較。 在對幾個國家和地區(qū)的監(jiān)管模式進(jìn)行分析之后,對我國所應(yīng)當(dāng)選擇或建立的監(jiān)管模式提出了建議,F(xiàn)行分業(yè)監(jiān)管體系下,應(yīng)當(dāng)對伊斯蘭金融業(yè)分業(yè)監(jiān)管;當(dāng)前我國伊斯蘭金融業(yè)還處于起步階段,因此應(yīng)當(dāng)單獨監(jiān)管,待發(fā)展成熟后,應(yīng)放開對機(jī)構(gòu)的差別化監(jiān)管,而實施統(tǒng)一的監(jiān)管;可對我國現(xiàn)行法律進(jìn)行修正或者借鑒迪拜國際金融中心的模式,在我國境內(nèi)設(shè)立一個可以自主制定區(qū)內(nèi)民商法的區(qū)域,用以發(fā)展伊斯蘭金融業(yè);對伊斯蘭金融業(yè)的沙里亞相適性進(jìn)行監(jiān)管;以巴塞爾協(xié)議和相關(guān)國際組織的標(biāo)準(zhǔn)作為基準(zhǔn)實施審慎監(jiān)管。
[Abstract]:In recent years, the Islamic financial industry has developed rapidly around the world. Countries that develop Islamic finance in the world will face a series of regulatory problems. Including the question of whether the Islamic financial sector should be regulated separately or incorporated into the traditional regulatory system, and how to exercise prudential supervision over the Islamic financial sector. Whether and how to regulate the compatibility of Sariya, whether to amend the current law or to legislate separately, etc. In this paper, Malaysia, Bahrain, Dubai International Financial Center, Britain and Pakistan are selected to adopt the mode of separate / mixed supervision to bring the Islamic financial industry into the traditional regulatory system / separate supervision. Whether separate laws on Islamic finance have been enacted and whether the regulators have set up the Sharia Commission within their institutions as indicators for the analysis and comparison of the supervision of the Islamic financial sector. After analyzing the regulatory models of several countries and regions, this paper puts forward some suggestions on the regulatory models that should be chosen or established in China. Under the current separate supervision system, the Islamic financial industry should be supervised separately, and at present, the Islamic financial industry in China is still in its infancy, so it should be supervised separately, and when it is mature, it should be opened to the differential supervision of the institutions. In order to develop Islamic financial industry, we can amend the current laws of our country or draw lessons from the model of Dubai International Financial Center, and set up a region in our country that can independently formulate the civil and commercial law in the region. To regulate the sharia suitability of the Islamic financial sector; to exercise prudential supervision based on the Basel Accord and the standards of relevant international organizations.
