【摘要】:信用卡從誕生以來,經(jīng)過六十多年的發(fā)展,現(xiàn)今已成為我們?nèi)粘I钪胁豢苫蛉钡囊环N支付工具之一,不論在美國(guó)、歐洲,還是亞太地區(qū),盡管各國(guó)(地區(qū))的經(jīng)濟(jì)發(fā)展水平、社會(huì)文化、支付習(xí)慣有較大差異,但信用卡在現(xiàn)代居民消費(fèi)支付中均起著不可替代的作用。與此相適應(yīng),為規(guī)范信用卡的經(jīng)營(yíng)行為,維護(hù)持卡人權(quán)益,促進(jìn)信用卡支付穩(wěn)健發(fā)展,,許多國(guó)家和地區(qū)都建立了有效的法律監(jiān)管體系,為信用卡產(chǎn)業(yè)發(fā)展構(gòu)建了強(qiáng)有力的安全保障環(huán)境。我國(guó)自第一張信用卡問世以來,從無到有、從小到大已走過了27個(gè)春秋,取得了舉世矚目的成就,信用卡已成為我國(guó)居民使用最頻繁的非現(xiàn)金支付工具,卡支付網(wǎng)絡(luò)已成為中國(guó)支付體系的重要組成部分,信用卡產(chǎn)業(yè)也已成為與老百姓切身利益和經(jīng)濟(jì)金融秩序相關(guān)的產(chǎn)業(yè)。但是從其他國(guó)家信用卡產(chǎn)業(yè)發(fā)展規(guī)律來看,這個(gè)時(shí)期正是最應(yīng)該警惕信用風(fēng)險(xiǎn)急劇膨脹的時(shí)期。本文通過對(duì)信用卡風(fēng)險(xiǎn)管理理論的梳理,并選取在信用卡業(yè)務(wù)領(lǐng)域最為發(fā)達(dá)的美國(guó)為研究對(duì)象,發(fā)現(xiàn)成功的信用風(fēng)險(xiǎn)控制與管理依賴于一套嚴(yán)謹(jǐn)而全面的信用風(fēng)險(xiǎn)管理體系,包括:市場(chǎng)化的組織體制、戰(zhàn)略化的管理體制、集約化的經(jīng)營(yíng)方式、順暢的運(yùn)作流程、完善的法律法規(guī)和監(jiān)管制度、發(fā)達(dá)的個(gè)人征信體系和良好的信用文化環(huán)境等,其中,發(fā)卡行內(nèi)部的控制管理與發(fā)卡行外部的環(huán)境保障兩個(gè)條件缺一不可。在我國(guó),與信用卡產(chǎn)業(yè)快速發(fā)展不相適應(yīng)的是:產(chǎn)業(yè)發(fā)展的法律制度建設(shè)和內(nèi)部風(fēng)險(xiǎn)控制管理手段仍較為滯后,如何規(guī)范信用卡使用和保障該產(chǎn)業(yè)順利發(fā)展無疑是一個(gè)擺在我們面前值得深入思考的問題。作者通過深入剖析我國(guó)信用卡市場(chǎng)風(fēng)險(xiǎn)管理現(xiàn)狀,認(rèn)為國(guó)內(nèi)發(fā)卡行在組織體制、管理體制、經(jīng)營(yíng)方式和運(yùn)作流程上都存在一些問題,造成信用風(fēng)險(xiǎn)敞口擴(kuò)大;從外部信用環(huán)境看,我國(guó)尚未建立健全的信用卡相關(guān)法律環(huán)境、行業(yè)監(jiān)管體制和全國(guó)性的個(gè)人征信體系,并且存在較為嚴(yán)重的信用文化缺失,這些都給發(fā)卡行帶來信用風(fēng)險(xiǎn)隱患。針對(duì)上述信用風(fēng)險(xiǎn)控制管理隱患,本文嘗試從經(jīng)濟(jì)、法律、文化等多個(gè)角度提出完善我國(guó)信用卡信用風(fēng)險(xiǎn)控制與管理的相應(yīng)對(duì)策和政策建議。
[Abstract]:After more than 60 years of development, credit cards have become one of the indispensable means of payment in our daily life, whether in the United States, Europe or the Asia-Pacific region, despite the level of economic development in various countries (regions). There are great differences in social culture and payment habits, but credit card plays an irreplaceable role in modern residents' consumption payment. In order to standardize the management of credit cards, safeguard the rights and interests of cardholders, and promote the steady development of credit card payments, many countries and regions have established effective legal and regulatory systems. For the development of credit card industry to build a strong security environment. Since the first credit card came out in our country, from nothing to existence, from small to large has gone through 27 Spring and Autumn period, and has made remarkable achievements. Credit card has become the most frequently used non-cash payment tool in our country. The card payment network has become an important part of the payment system in China, and the credit card industry has also become the industry related to the vital interests of the common people and the economic and financial order. But judging from the development law of credit card industry in other countries, this period is the period when credit risk expands rapidly. By combing the theory of credit card risk management, and selecting the United States, which is the most developed credit card business field, as the research object, this paper finds that successful credit risk control and management depend on a rigorous and comprehensive credit risk management system. Including: a market-oriented organizational system, a strategic management system, an intensive management mode, a smooth operation process, a sound legal and regulatory system, a developed personal credit information system and a good credit culture environment, etc., The internal control management of the issuing bank and the external environmental protection of the card issuing bank are indispensable. In China, the rapid development of credit card industry is not suited to: the legal system construction of industrial development and internal risk control management means are still lagging behind. How to standardize the use of credit cards and ensure the smooth development of the industry is undoubtedly a problem worthy of further consideration in front of us. By deeply analyzing the present situation of credit card market risk management in China, the author thinks that there are some problems in the organization system, management system, management mode and operation process of domestic credit card issuers, which results in the expansion of credit risk exposure. From the external credit environment, China has not yet established a sound credit card related legal environment, industry regulatory system and national personal credit system, and there is a serious lack of credit culture. These all bring credit risk hidden trouble to the issuing bank. Aiming at the hidden trouble of credit risk control and management, this paper tries to put forward the corresponding countermeasures and policy suggestions to perfect credit card credit risk control and management in China from the aspects of economy, law, culture and so on.
