從立法角度研究我國民間借貸的監(jiān)管問題

【摘要】:從2003年開始國家對民間小額信貸的限制逐步放開,并出臺了相關(guān)的扶持政策,使民間借貸得到了迅速地發(fā)展。現(xiàn)在民間借貸問題已經(jīng)成了整個(gè)社會關(guān)注的焦點(diǎn)。民間借貸是中小企業(yè)融資的一種途徑,2008年湖南省企業(yè)調(diào)查隊(duì)對民間融資情況進(jìn)行了調(diào)查,結(jié)果顯示有50%的中小企業(yè)通過民間借貸的方式進(jìn)行融資。所以,民間借貸是正規(guī)金融的重要補(bǔ)充,也是我國經(jīng)濟(jì)市場中不可缺少的一部分,對推動我國經(jīng)濟(jì)發(fā)展有積極的一面。但是多年以來,我國一直缺乏法律和制度對民間借貸進(jìn)行行之有效的監(jiān)督和管理。在立法上遲遲沒有出臺相關(guān)法律來規(guī)范民間借貸,對民間借貸的監(jiān)管無法可依,致使民間借貸在無基本法可依又極有市場的背景下泛濫。民間借貸在沒有立法對其進(jìn)行規(guī)范的情況下,處于無序發(fā)展的狀態(tài)之中,擾亂了金融秩序,阻礙了經(jīng)濟(jì)的發(fā)展。所以,從立法上加強(qiáng)對民間借貸的監(jiān)管,建立健全有關(guān)民間借貸的法律和制度刻不容緩。 文章主要從立法角度對民間借貸的監(jiān)管進(jìn)行研究。首先,文章闡述了民間借貸的現(xiàn)狀,對民間借貸的概念、種類、特點(diǎn)、產(chǎn)生和發(fā)展的原因和溫州金融改革這些基本問題進(jìn)行了詳細(xì)的論述,之后又指出了民間借貸存在的隱患以及民間借貸監(jiān)管的現(xiàn)狀和缺陷。其次,文章在分析了民間借貸存在的隱患和監(jiān)管存在缺陷的基礎(chǔ)上,提出了立法的必要性,并且借鑒了民間借立法比較完善的美國、日本和我國港臺地區(qū)的民間借貸法律制度。文章最后一部分在結(jié)合我國民間借貸監(jiān)管的現(xiàn)狀、借鑒國外和我國港臺地區(qū)民間借貸監(jiān)管的經(jīng)驗(yàn)的基礎(chǔ)上,提出了從確立我國民間借貸監(jiān)管的法律原則、完善有關(guān)民間借貸的法律規(guī)定和構(gòu)建我國民間借貸監(jiān)管的具體法律制度這三個(gè)方面來健全我國民間借貸監(jiān)管的法律體系和制度,加強(qiáng)對民間借貸的監(jiān)管。
[Abstract]:From the beginning of 2003 the national restrictions on private microfinance gradually liberalized, and introduced the relevant supporting policies, the private lending has been developed rapidly. Now the problem of private lending has become the focus of the whole society. Private lending is a way of financing of small and medium-sized enterprises, enterprises in Hunan Province in 2008 conducted a survey on the investigation team the folk financing situation, the result shows that 50% of the small and medium-sized enterprise financing through the private lending. So, private lending is an important supplement of formal finance, is also a part of our market economy indispensable, there is a positive side to promote the economic development of our country. But over the years, China has been the lack of legal system and effective supervision and management of private lending. In the legislation has not promulgated relevant laws to regulate private lending, private lending regulation could be caused by No law can make the folk lending in the market are very rampant. Under the background of private lending in the absence of legislation to regulate the status of its development, is in a disordered state, disrupting financial order, hindered the economic development. Therefore, from the legislation to strengthen the supervision of folk loan, establish and perfect the relevant delay private lending laws and regulations.
This article mainly conducts the research of supervision of private lending from the angle of legislation. Firstly, this paper expounds the present situation of private lending, private lending on the concept, types, characteristics, causes and development of the Wenzhou financial reform and these basic problems are discussed in detail, and then pointed out the existence of private lending and private lending regulatory risks the status quo and defects. Secondly, this paper analyzes the problems and defects of the supervision of private lending on the basis, put forward the necessity of legislation, and from the private lending legislation is perfect in the United States, Japan and Hong Kong, the legal system of private lending. In the last part of the article according to the present situation of private lending regulation in our country, referring to foreign and private lending regulation in Hong Kong and Taiwan of China experience, put forward from the establishment of China's private lending regulation law is perfect We should improve the legal system and system of private lending supervision in China from three aspects: the legal provisions of private lending and the specific legal system of private lending supervision in China, so as to strengthen the supervision of private lending.
