【摘要】:1996年,捷克斯洛伐克推出了世界上第一個(gè)商業(yè)性運(yùn)作的手機(jī)銀行,其后,各國(guó)商業(yè)銀行也紛紛推出手機(jī)銀行業(yè)務(wù)。如今,歷經(jīng)近20年的進(jìn)化與升級(jí),手機(jī)銀行已經(jīng)成長(zhǎng)為眾多金融機(jī)構(gòu)提供的一項(xiàng)非常普遍的金融服務(wù)。 從全球的整體發(fā)展?fàn)顩r來(lái)看,歐美地區(qū)的手機(jī)銀行起步較早,但受傳統(tǒng)的消費(fèi)習(xí)慣影響,手機(jī)銀行尚未成為主流的支付方式;日韓手機(jī)銀行的發(fā)展最為成熟,用戶(hù)接受度較高;菲律賓、肯尼亞等發(fā)展中國(guó)家變革性的手機(jī)銀行,依托發(fā)達(dá)的零售代理商網(wǎng)絡(luò),拓寬了農(nóng)村的金融服務(wù)渠道,為低收入人群獲取正規(guī)金融服務(wù)提供了便利。 國(guó)內(nèi)的手機(jī)銀行業(yè)務(wù)興起于1999年。后幾經(jīng)波折,近年來(lái),由于3G網(wǎng)絡(luò)的推廣、智能手機(jī)的普及以及各項(xiàng)政策措施的出臺(tái)與完善,我國(guó)的手機(jī)銀行業(yè)務(wù)迎來(lái)了一個(gè)快速發(fā)展的階段。商業(yè)銀行、移動(dòng)運(yùn)營(yíng)商、第三方支付企業(yè)等各參與主體,不斷推出更加方便、快捷、個(gè)性化的手機(jī)銀行產(chǎn)品,以搶占市場(chǎng)地位與市場(chǎng)份額,尤其是在手機(jī)支付領(lǐng)域展開(kāi)了激烈的市場(chǎng)競(jìng)爭(zhēng)。 相對(duì)于手機(jī)銀行發(fā)展的如火如荼,國(guó)內(nèi)對(duì)該業(yè)務(wù)的監(jiān)管卻一直處于比較滯后的狀態(tài)。而手機(jī)銀行作為一種新型的金融服務(wù),有其特有的風(fēng)險(xiǎn)與安全問(wèn)題,需要予以適當(dāng)?shù)谋O(jiān)管。因此,亟需對(duì)當(dāng)前我國(guó)手機(jī)銀行的監(jiān)管現(xiàn)狀進(jìn)行分析,并提出切實(shí)有效的完善改革建議。 本文從國(guó)內(nèi)手機(jī)銀行的發(fā)展現(xiàn)狀和監(jiān)管現(xiàn)狀兩個(gè)方面展開(kāi)分析,指出現(xiàn)階段我國(guó)手機(jī)銀行業(yè)務(wù)的諸多監(jiān)管漏洞,比如,手機(jī)銀行監(jiān)管法律體系不完善、監(jiān)管部門(mén)之間協(xié)調(diào)性差,缺乏信息披露制度,缺乏對(duì)金融消費(fèi)者權(quán)益的保護(hù)。在文章的最后,筆者借鑒國(guó)際上手機(jī)銀行的發(fā)展現(xiàn)實(shí)和監(jiān)管經(jīng)驗(yàn),提出了完善手機(jī)銀行監(jiān)管的對(duì)策建議,以保證既能有效地控制業(yè)務(wù)風(fēng)險(xiǎn),維持行業(yè)穩(wěn)定發(fā)展,又能夠確定公平的競(jìng)爭(zhēng)原則,為手機(jī)銀行創(chuàng)造良性的市場(chǎng)競(jìng)爭(zhēng)環(huán)境。
[Abstract]:In 1996, Czechoslovakia launched the world's first commercial mobile bank, and then commercial banks from all over the world also launched mobile banking business. Now, after nearly 20 years of evolution and upgrading, Mobile banking has grown into a very common financial service provided by many financial institutions. Judging from the overall development of the world, mobile banking in Europe and America started early, but under the influence of traditional consumption habits, mobile banking has not yet become the mainstream payment method. The development of mobile banks in Japan and Korea is the most mature. The mobile phone banks in developing countries such as the Philippines and Kenya, relying on the developed network of retail agents, broaden the channels of rural financial services and provide convenience for low-income people to access formal financial services. Domestic mobile banking business rose in 1999. After several twists and turns, in recent years, due to the promotion of 3G networks, the popularity of smart phones and the introduction and improvement of various policies and measures, The mobile banking business in our country has ushered in a rapid development stage. Commercial banks, mobile operators, third-party payment enterprises, and other participating parties, continue to launch more convenient, fast, personalized mobile banking products. In order to seize the market position and market share, especially in the field of mobile phone payment launched fierce market competition. In contrast to the rapid development of mobile banking, domestic supervision of the business has been lagging behind. As a new type of financial service, mobile banking has its own risks and security problems. Therefore, it is urgent to analyze the current situation of mobile banking supervision in China, and put forward practical and effective suggestions to improve the reform. This paper analyzes the current development and supervision of mobile banking in China, and points out that the legal system of mobile banking is not perfect. There is poor coordination among regulators, lack of information disclosure system, lack of protection of the rights and interests of financial consumers. At the end of the article, the author draws lessons from the development reality and supervision experience of mobile banking in the world. The paper puts forward some countermeasures and suggestions to improve the supervision of mobile banking, so as to ensure the effective control of business risks, maintain the steady development of the industry, and determine the principle of fair competition so as to create a benign market competition environment for mobile banking.
