【摘要】：選擇兌換日也就意味著選擇匯率,這是外幣債務(wù)判決中無法避免的問題。國際上先后出現(xiàn)過三種兌換日規(guī)則,即違約日規(guī)則、支付日規(guī)則和聯(lián)邦規(guī)則。但任何一種單一兌換規(guī)則都存在其自身的缺陷或弊端,沒有哪一個規(guī)則可以絕對地、強(qiáng)制性地適用于外幣債務(wù)判決中。一種更加靈活的規(guī)則即"合理方法"應(yīng)該得到各國法院的推崇和支持,根據(jù)該規(guī)則,法院只能通過對具體案件的分析,對當(dāng)時國際匯率形勢的觀察,才能得出公平合理的解決辦法。
[Abstract]:Choosing the exchange date means choosing the exchange rate, which is an unavoidable problem in the judgment of foreign currency debt. There have been three kinds of convertibility day rules in the world, namely, the date of breach of contract rule. The payment day rule and the federal rule. But any single convertibility rule has its own flaws or drawbacks, and no single rule can be absolutely, Mandatory application to foreign currency debt judgements... a more flexible rule, the "reasonable method", should be respected and supported by national courts, according to which the Court can only analyse specific cases, Only by observing the international exchange rate situation at that time can we arrive at a fair and reasonable solution.
