【摘要】：自加入世界貿(mào)易組織以來(lái),我國(guó)經(jīng)濟(jì)發(fā)展持續(xù)穩(wěn)步發(fā)展,科技創(chuàng)新水平不斷攀升,同時(shí)在面對(duì)國(guó)際間的貿(mào)易競(jìng)爭(zhēng)時(shí),我國(guó)企業(yè)越來(lái)越多的意識(shí)到,知識(shí)產(chǎn)權(quán)已成為限制自身發(fā)展走向國(guó)際化的一個(gè)重要因素,我國(guó)也已經(jīng)認(rèn)識(shí)到發(fā)展知識(shí)產(chǎn)權(quán)對(duì)于提高國(guó)際競(jìng)爭(zhēng)力的重要意義。2016年,國(guó)務(wù)院辦公廳發(fā)布了《知識(shí)產(chǎn)權(quán)綜合管理改革試點(diǎn)總體方案》,從國(guó)家層面出發(fā),對(duì)我國(guó)各地方政府在推行知識(shí)產(chǎn)權(quán)制度中出現(xiàn)的管理體制不完善、保護(hù)程序不夠嚴(yán)格、服務(wù)的能力和水平不高、推進(jìn)創(chuàng)新驅(qū)動(dòng)的支持和鼓勵(lì)上缺乏行之有效的政策等突出問(wèn)題,提出了有針對(duì)性和可操作性的指導(dǎo)意見(jiàn)。景德鎮(zhèn)作為一個(gè)享譽(yù)中外的“瓷都”,擁有上千年制瓷歷史,制瓷業(yè)一直是當(dāng)?shù)匕l(fā)展的支柱產(chǎn)業(yè),其手工制瓷技藝始終延續(xù)沒(méi)有斷層,得到了很好的傳承和保留,而在當(dāng)今這個(gè)以科技創(chuàng)新為主導(dǎo)的時(shí)代,如何在傳統(tǒng)和創(chuàng)新之間保持平衡,取得最好的發(fā)展效果,這正是景德鎮(zhèn)陶瓷企業(yè)在生存和發(fā)展壯大中面臨的問(wèn)題。作為政府,在規(guī)范陶瓷行業(yè)秩序的過(guò)程中,面對(duì)在實(shí)際管理中出現(xiàn)的一系列知識(shí)產(chǎn)權(quán)問(wèn)題如:知識(shí)產(chǎn)權(quán)在企業(yè)的重視度不高;侵權(quán)的打擊力度不大、效果不好;各部門的利益協(xié)調(diào)和配合不一致等。從促進(jìn)和發(fā)展陶瓷行業(yè)的目的出發(fā),需要制定完善的知識(shí)產(chǎn)權(quán)保護(hù)制度來(lái)鼓勵(lì)和維護(hù)企業(yè)的科技創(chuàng)新成果。本文通過(guò)闡述知識(shí)產(chǎn)權(quán)相關(guān)概念,在了解和研究一些歐洲發(fā)達(dá)國(guó)家的知識(shí)產(chǎn)權(quán)管理制度的基礎(chǔ)上,結(jié)合我國(guó)知識(shí)產(chǎn)權(quán)保護(hù)現(xiàn)狀,深入調(diào)查近年來(lái)景德鎮(zhèn)陶瓷產(chǎn)業(yè)生存和發(fā)展的實(shí)際情況,通過(guò)調(diào)查深入細(xì)致地分析景德鎮(zhèn)在陶瓷行業(yè)知識(shí)產(chǎn)權(quán)保護(hù)方面采取的措施、存在的問(wèn)題、分析問(wèn)題產(chǎn)生的原因,并以此為依據(jù),從司法保護(hù)和行政保護(hù)兩個(gè)方面提出合理有效的建議和對(duì)策,為景德鎮(zhèn)政府實(shí)施陶瓷知識(shí)產(chǎn)權(quán)保護(hù),促進(jìn)和發(fā)展陶瓷產(chǎn)業(yè)提供參考依據(jù)。
[Abstract]:Since China's entry into the World Trade Organization (WTO), China's economy has been developing steadily and the level of scientific and technological innovation has been rising. At the same time, in the face of international trade competition, more and more Chinese enterprises have realized that, Intellectual property has become an important factor that limits its development to internationalization. China has also realized the importance of developing intellectual property to improve international competitiveness. In 2016, The General Office of the State Council has issued the "General pilot Plan for the Comprehensive Management of intellectual property Rights", which, proceeding from the national level, is not perfect enough in the management system and the procedures for the protection of the intellectual property rights that appear in the implementation of the intellectual property system by various local governments in China. Such outstanding problems as the low capacity and level of services, the lack of effective policies to promote innovation-driven support and incentives, As a famous "porcelain capital" in China and abroad, Jingdezhen has a history of making porcelain for thousands of years, and the porcelain industry has always been the pillar industry of local development. Has been well inherited and preserved, and in this era dominated by scientific and technological innovation, how to maintain a balance between tradition and innovation and achieve the best development results, This is precisely the problem that Jingdezhen ceramic enterprises face in their survival and development. As a government, in the process of standardizing the order of the ceramic industry, In the face of a series of intellectual property problems in the actual management such as: intellectual property rights in the enterprise attention is not high, the impact of infringement is not strong, the effect is not good; For the purpose of promoting and developing the ceramic industry, It is necessary to establish a perfect intellectual property protection system to encourage and safeguard the scientific and technological innovation achievements of enterprises. This paper expounds the concepts related to intellectual property rights, and on the basis of understanding and studying the intellectual property management systems of some European developed countries, Combined with the current situation of intellectual property protection in China, the actual situation of the existence and development of Jingdezhen ceramic industry in recent years is investigated in depth, and the measures and existing problems in the protection of intellectual property rights of Jingdezhen are analyzed deeply and meticulously through the investigation. Based on the analysis of the causes of the problems, this paper puts forward some reasonable and effective suggestions and countermeasures from the aspects of judicial protection and administrative protection, which provides a reference for Jingdezhen government to implement the protection of ceramic intellectual property rights and to promote and develop the ceramic industry.
