【摘要】：“知名商品特有名稱”這一詞匯在世界各國法律規(guī)定中都很少使用,但在我國，知名商品特有名稱是一項(xiàng)可以與商標(biāo)相媲美的商業(yè)標(biāo)志，有著與商標(biāo)幾乎同等的法律意義和價值，但由于法律規(guī)定的不完善，致使其在司法實(shí)踐中經(jīng)常出現(xiàn)問題。筆者結(jié)合我國司法實(shí)踐中的具體障礙，以我國知識產(chǎn)權(quán)相關(guān)法律為基礎(chǔ)，介紹了知名商品特有名稱的定義、認(rèn)定標(biāo)準(zhǔn)，同時本文將以知名商品特有名稱在司法實(shí)踐中遇到的問題作為重點(diǎn)，，針對各個問題分析原因，并提出解決對策及立法完善。
[Abstract]:The term "special name of well-known commodity" is rarely used in the laws and regulations of all countries around the world, but in our country, the special name of well-known commodity is a commercial mark comparable to that of trademark. It has almost the same legal significance and value as the trademark, but due to the imperfection of the law, it often appears problems in the judicial practice. Combining with the concrete obstacles in the judicial practice of our country and based on the related laws of intellectual property rights in China, the author introduces the definition and standard of the special name of well-known commodities. At the same time, this paper will focus on the problems encountered in judicial practice by the special name of well-known commodities, analyze the reasons for each problem, and propose solutions and legislative improvement.
