廣東省中藥復(fù)方專(zhuān)利的現(xiàn)狀分析及保護(hù)與發(fā)展策略研究

【摘要】：目的：本研究的總體目標(biāo)是在研究中藥復(fù)方專(zhuān)利制度的基礎(chǔ)上,依托專(zhuān)利信息資源,運(yùn)用統(tǒng)計(jì)學(xué)聚類(lèi)分析和回歸分析的方法,重點(diǎn)針對(duì)廣東省2004—2013年中藥復(fù)方專(zhuān)利數(shù)據(jù)進(jìn)行分析,了解中藥復(fù)方藥品專(zhuān)利整體發(fā)展水平和廣東省該領(lǐng)域的整體情況和存在問(wèn)題。針對(duì)當(dāng)前存在的問(wèn)題從政府、市場(chǎng)、企業(yè)等方面對(duì)廣東省中藥復(fù)方專(zhuān)利藥品的研發(fā)與保護(hù)進(jìn)行發(fā)展策略研究。方法：1.文獻(xiàn)研究法�；谌f(wàn)方數(shù)據(jù)平臺(tái)、維普中文科技期刊數(shù)據(jù)庫(kù)、PUBMED英文文獻(xiàn)數(shù)據(jù)庫(kù)、Science Direct數(shù)據(jù)庫(kù)和SLCC西文期刊數(shù)據(jù)庫(kù)以及相關(guān)書(shū)籍報(bào)刊,通過(guò)研究近十多年關(guān)于中藥復(fù)方專(zhuān)利保護(hù)、中藥復(fù)方研究、專(zhuān)利信息利用、中醫(yī)藥知識(shí)產(chǎn)權(quán)保護(hù)、醫(yī)藥專(zhuān)利制度研究等多方面的文獻(xiàn),以了解國(guó)內(nèi)外有關(guān)中醫(yī)藥專(zhuān)利保護(hù)、中藥復(fù)方研發(fā)、專(zhuān)利申報(bào)與保護(hù)的理論知識(shí)、研究發(fā)展及最新趨勢(shì),找出存在于我省中藥復(fù)方專(zhuān)利保護(hù)和發(fā)展過(guò)程中的具體問(wèn)題。2.訪問(wèn)廣東省知識(shí)產(chǎn)權(quán)局、廣州中醫(yī)藥大學(xué)經(jīng)管學(xué)院和廣東省知識(shí)產(chǎn)權(quán)研究與發(fā)展中心有關(guān)專(zhuān)家,就專(zhuān)利數(shù)據(jù)庫(kù)的建立、專(zhuān)利統(tǒng)計(jì)學(xué)指標(biāo)的選取、專(zhuān)利統(tǒng)計(jì)學(xué)分析、中藥復(fù)方知識(shí)產(chǎn)權(quán)侵權(quán)判定、知識(shí)產(chǎn)權(quán)發(fā)展策略研究及論文寫(xiě)作過(guò)程中出現(xiàn)的問(wèn)題等方面做定期的請(qǐng)教與探討,并做好歸納總結(jié)。3.專(zhuān)利檢索法及專(zhuān)利地圖法。本研究廣東省戰(zhàn)略新型專(zhuān)利平臺(tái)(大為Patent)、中國(guó)專(zhuān)利信息中心專(zhuān)利平臺(tái)、國(guó)家知識(shí)產(chǎn)權(quán)局專(zhuān)利平臺(tái)、SOOPAT專(zhuān)利數(shù)據(jù)庫(kù)、CNIPR中外專(zhuān)利平臺(tái)。對(duì)符合條件的中藥復(fù)方專(zhuān)利信息分析匯總,選用相關(guān)專(zhuān)利指標(biāo),從中挖掘有效信息,從發(fā)展趨勢(shì)、地域分布、發(fā)明人分析、有效時(shí)間影響因素等幾點(diǎn)進(jìn)行探索性分析,把握該領(lǐng)域的總體情形和趨勢(shì)。4.統(tǒng)計(jì)分析法。本研究主要選用spss19.0和exce12007為統(tǒng)計(jì)軟件,在廣東省十年間中藥復(fù)方專(zhuān)利發(fā)展趨勢(shì)、地域分布、專(zhuān)利功效分布及專(zhuān)利維持時(shí)間影響因素方面進(jìn)行了K-mean值聚類(lèi)分析、二元Logistic回歸分析及線(xiàn)性回歸分析。結(jié)果：數(shù)據(jù)挖掘處理后,得出如下結(jié)果：1.省內(nèi)十年間總體保持上升態(tài)勢(shì),但省內(nèi)區(qū)域間狀態(tài)相差懸殊。2.從申請(qǐng)人來(lái)看,高校和個(gè)人申請(qǐng)量較多,但專(zhuān)利維持量水平不高。3.授權(quán)專(zhuān)利維持時(shí)間不高申請(qǐng)人類(lèi)型、專(zhuān)利權(quán)是否轉(zhuǎn)移、是否有專(zhuān)利代理公司、從屬權(quán)利要求數(shù)量、是否提供實(shí)驗(yàn)數(shù)據(jù)、申請(qǐng)書(shū)頁(yè)數(shù)和是否開(kāi)創(chuàng)新劑型依次為主要原因。4.未獲授權(quán)專(zhuān)利占半數(shù)以上,未繳年費(fèi)、公布后視為撤回和公布后駁回分列無(wú)效原因前三位。結(jié)論：廣東省在該領(lǐng)域保護(hù)與發(fā)展主要需改善的地方有：1.完善中藥復(fù)方專(zhuān)利制度。2.增強(qiáng)科研成果的轉(zhuǎn)化水平。3.專(zhuān)利質(zhì)量有待提升。4.企業(yè)的復(fù)方研發(fā)能力有待加強(qiáng)。5.區(qū)域間交流合作有待加強(qiáng)。6.政府要加大扶持力度和引導(dǎo)正確輿論導(dǎo)向。針對(duì)上述問(wèn)題,從政府法制與政策更加健全完善、企業(yè)提高研發(fā)能力與專(zhuān)利信息利用能力、產(chǎn)學(xué)研聯(lián)盟和區(qū)域間交流合作以及知識(shí)產(chǎn)權(quán)平臺(tái)構(gòu)建與復(fù)合型人才培養(yǎng)等方面提出了建議策略。

The non-authorized patent accounts for more than half of the total, and the total unpaid annual fee is deemed to be withdrawn and published after the publication, and the first three of the reasons for the invalid are dismissed. Conclusion: Guangdong's protection and development in this area mainly need to be improved:1. Improve that compound patent system of traditional Chinese medicine. The level of transformation of scientific research results is enhanced. The quality of the patent is to be upgraded. The compound R & D capability of the enterprise is to be strengthened. The interregional exchange of information has to be strengthened.6. The government should strengthen the support and guide the correct public opinion. In the light of the above-mentioned problems, the author puts forward the proposed strategy from the aspects of the improvement of the government's legal system and the policy, the improvement of the R & D capability of the enterprise, the ability of the patent information utilization, the industry-university-research alliance and the interregional exchange cooperation, and the construction of the intellectual property platform and the compound personnel training.
