【摘要】：在當(dāng)今經(jīng)濟(jì)競(jìng)爭(zhēng)中，商業(yè)秘密己成為一種重要的無(wú)形財(cái)產(chǎn)。但在市場(chǎng)經(jīng)濟(jì)條件下，侵犯商業(yè)秘密的行為還經(jīng)常發(fā)生，特別是隨著世界經(jīng)濟(jì)一體化和國(guó)際互聯(lián)網(wǎng)的快速發(fā)展以及電子商務(wù)的越來(lái)越普遍，使本己十分突出的商業(yè)秘密的保護(hù)問(wèn)題更加嚴(yán)重。在網(wǎng)絡(luò)環(huán)境下，商業(yè)秘密被侵犯有了新的形式和特點(diǎn)。商業(yè)秘密一旦通過(guò)網(wǎng)絡(luò)被披露，則權(quán)利人的損失是無(wú)法估量的。利用網(wǎng)絡(luò)侵犯商業(yè)秘密的違法行為具有極強(qiáng)的隱蔽性，，社會(huì)危害性極大。本文著重研究了在網(wǎng)絡(luò)環(huán)境下各國(guó)對(duì)商業(yè)秘密的保護(hù)現(xiàn)狀，針對(duì)目前網(wǎng)絡(luò)環(huán)境下我國(guó)對(duì)商業(yè)秘密的保護(hù)存在的不足之處，提出了如何保護(hù)好網(wǎng)絡(luò)中的商業(yè)秘密的建議。文章共分三個(gè)部分，第一部分寫(xiě)了在網(wǎng)絡(luò)環(huán)境下商業(yè)秘密的概述，以及在網(wǎng)絡(luò)環(huán)境下商業(yè)秘密保護(hù)面臨新的挑戰(zhàn)。第二部分主要論述了世界各國(guó)在網(wǎng)絡(luò)環(huán)境下的商業(yè)秘密的保護(hù)現(xiàn)狀，同時(shí)指出了在網(wǎng)絡(luò)環(huán)境下我國(guó)對(duì)商業(yè)秘密保護(hù)的不足。第三部分是結(jié)論部分，主要論述了網(wǎng)絡(luò)環(huán)境下完善商業(yè)秘密保護(hù)的措施。
[Abstract]:In today's economic competition, trade secrets have become an important intangible property. However, under the condition of market economy, the violation of trade secrets often occurs, especially with the rapid development of the world economy and the Internet, as well as the increasing popularity of electronic commerce. This has made the protection of trade secrets more serious. Under the network environment, the trade secret is violated has the new form and the characteristic. Once the trade secret is disclosed through the network, the loss of the obligee is incalculable. The illegal behavior of infringing on trade secret by network has strong concealment and great harm to society. This paper focuses on the current situation of trade secret protection in various countries under the network environment, and puts forward some suggestions on how to protect the trade secret in the network environment in view of the shortcomings of our country's trade secret protection under the current network environment. This paper is divided into three parts. The first part is an overview of trade secrets in the network environment, and the new challenges to the protection of business secrets in the network environment. The second part mainly discusses the current situation of the trade secret protection in the world under the network environment, and points out the insufficiency of our country's trade secret protection under the network environment. The third part is the conclusion part, which mainly discusses the measures to perfect the trade secret protection under the network environment.
