背景音樂使用收費制度研究

【摘要】: 背景音樂收費制度的啟動是我國自新修訂的《著作權(quán)法》頒布之后,一項頗為引人注目的旨在保護著作權(quán)人合法權(quán)益的舉措。應(yīng)當承認,從保障權(quán)利人利益的角度來說,我國背景音樂收費制度的實施已經(jīng)大大晚于西方發(fā)達國家,,其中既有制度的原因、立法的原因,也有人們觀念上的原因。而要確立背景音樂收費制度的合理性與合法性,除了相關(guān)法律制度配套建設(shè)之外,人們傳統(tǒng)觀念的改變是也同樣是非常必要的。這首先要求我們將著作權(quán)理解為一種私權(quán),而背景音樂的播放作為使用有著作權(quán)的音樂作品的一種形式,是受著作權(quán)法律規(guī)制與保護的。營利性場所將有著作權(quán)保護的音樂作品作為背景音樂播放本身就是一種營利行為,所以權(quán)利人要求支付許可使用費是天經(jīng)地義的。 文章第二部分的內(nèi)容涉及到背景音樂許可使用費收取對象的界定以及使用費標準的性質(zhì)和數(shù)額確定的問題。這一部分以許可使用費標準為重,不僅涉及到標準的具體內(nèi)容,特別涉及到了對標準性質(zhì),即背景音樂使用收費行為的性質(zhì)如何理解的問題。文章首先指出,背景音樂收費行為的本質(zhì)是民事行為,進而闡述了背景音樂收費標準的性質(zhì),即背景音樂的收費標準不是行政法規(guī),而僅僅是雙方協(xié)商的基礎(chǔ)。 第三部分主要討論背景音樂許可使用費請求權(quán)的行使。這一部分首先簡要介紹了當前我國的著作權(quán)集體管理組織,然后重點論述著作權(quán)集體管理組織與收費對象之間的權(quán)利義務(wù)關(guān)系,其中包括了著作權(quán)集體管理組織行使權(quán)利的依據(jù),即權(quán)力的來源,以及雙方爭議解決制度等內(nèi)容。 文章的最后一個部分為許可使用費收取后如何在權(quán)利人之間分配的問題。這一部分包括了兩個內(nèi)容:一是作者之間的收益分配,二是鄰接權(quán)人在收益分配中的地位。由于鄰接權(quán)人的合法權(quán)益在背景音樂收費制度中較容易被忽視,所以如何實現(xiàn)錄音者、表演者的利益是完善背景音樂收費制度的重要內(nèi)容。 我國的背景音樂使用收費制度的完善實際上涉及到了我國整個著作權(quán)制度有關(guān)音樂作品著作權(quán)內(nèi)容的制度建設(shè),比如著作權(quán)集體管理制度的完善就不僅僅只是一個背景音樂使用收費制度所要解決的問題,而涉及到了整個著作權(quán)立法的完善。在這一過程中,無論是觀念還是立法的進步,都不是一個輕松的過程。
[Abstract]:Background the initiation of music charging system is a remarkable measure to protect the legitimate rights and interests of copyright owners after the newly revised copyright Law was promulgated in China. It should be acknowledged that from the perspective of protecting the interests of the obligee, the implementation of the background music fee system in China has been much later than that in the western developed countries, including the reasons of the system, the reason of legislation, and the reason of people's idea. In order to establish the rationality and legitimacy of the background music charging system, it is also necessary to change people's traditional concepts in addition to the related legal system. This requires us to understand copyright as a private right, and the play of background music is regulated and protected by copyright law as a form of using copyrighted musical works. It is a profitable act for for-profit places to play music works protected by copyright as background music, so it is natural for the obligee to demand the payment of royalties. The second part of the article involves the definition of the object of background music license fee collection and the determination of the nature and amount of the user fee standard. This part focuses on the licensing fee standard, not only the specific content of the standard, especially about the standard nature, that is, the nature of the background music use charge behavior how to understand. Firstly, the paper points out that the nature of background music charging is civil behavior, and then expounds the nature of background music charging standard, that is, the background music charging standard is not administrative regulations, but only the basis of negotiation between the two sides. The third part mainly discusses the application of background music license fee. This part first briefly introduces the copyright collective management organization in our country, and then focuses on the relationship between the copyright collective management organization and the charging object. It includes the basis of the exercise of the rights of the copyright collective management organization, namely the source of the power, and the dispute settlement system between the two sides. The last part of the article is about how to distribute the royalties among the right holders. This part includes two parts: one is the income distribution between the author and the other is the position of the neighbor in the income distribution. Because the legitimate rights and interests of the neighboring rights and interests in the background music fee system is easy to be ignored, so how to achieve recording, the interests of performers is an important content to improve the background music charging system. The perfection of the system of charging for the use of background music in our country actually involves the construction of the whole copyright system of our country concerning the content of the copyright of music works. For example, the improvement of copyright collective management system is not only a background music use fee system to solve the problem, but also involves the improvement of the whole copyright legislation. In this process, whether the idea or legislative progress, is not an easy process.
