【摘要】：對馳名商標的相關(guān)問題進行研究并非新問題,而是常說常新,尤其是我國正在對《商標法》進行第三次修訂,盡管本次修訂就完善馳名商標的認定和保護相關(guān)制度做了努力,但是限于國情及實踐的發(fā)展,此次修訂也不是完美無缺,在認定標準、程序和效力以及保護的范圍、力度和權(quán)利的合理限制方面仍然存在需要完善的空間,如何就完善相關(guān)制度探索出適合我國國情的立法道路,維護良好的市場競爭秩序,促進經(jīng)濟健康發(fā)展,就成為知識產(chǎn)權(quán)法和經(jīng)濟法領(lǐng)域的重要課題,具有十分重大的理論和現(xiàn)實意義。 文章結(jié)合修訂的背景,通過闡述混淆理論、聯(lián)想理論、淡化理論,為馳名商標特殊保護尋求理論支撐和保護依據(jù),采用了比較研究方法、實證研究方法和案例研究方法,結(jié)合相關(guān)法律法規(guī)、部門規(guī)章及司法解釋等規(guī)定,對完善我國馳名商標制度進行了法律思考,在馳名商標的認定制度方面,明確認定因素、標準、程序等；在馳名商標的保護制度方面,引入反淡化理論保護機制、增加防御性注冊制度、加強對未注冊馳名商標的保護、完善我國馳名商標的域外保護制度等；在馳名商標的權(quán)利合理限制方面,禁止在商品的包裝和廣告宣傳中使用“馳名商標”字樣或者口號,并對馳名商標在轉(zhuǎn)讓或者許可權(quán)利方面設(shè)置合理的限制。通過研究和分析,為我國立法提供借鑒,維護馳名商標制度的完整性和合理性。
[Abstract]:The research on the related problems of well-known trademarks is not new, but often new, especially the third revision of the Trademark Law in China, although this revision has made great efforts to perfect the recognition and protection system of well-known trademarks. However, due to the development of national conditions and practice, this revision is not perfect. There is still room for perfection in the determination of standards, procedures and effectiveness, as well as the scope, strength and reasonable limits of protection, It has become an important topic in the field of intellectual property law and economic law that how to explore the legislative road suitable for the national conditions of our country, how to improve the relevant systems, how to maintain a good market competition order, and how to promote the healthy development of the economy. It is of great theoretical and practical significance. Based on the background of the revision, this paper expounds the theory of confusion, association theory and desalination theory, seeks theoretical support and protection basis for the special protection of well-known trademarks, and adopts comparative research method, empirical research method and case study method. In combination with relevant laws and regulations, department rules and judicial interpretation, this paper makes legal considerations on how to perfect the well-known trademark system in our country, and clearly identifies the factors, standards, procedures and so on in the recognition system of well-known trademarks. In the protection system of well-known trademark, we should introduce anti-desalination theory protection mechanism, increase defensive registration system, strengthen the protection of unregistered well-known trademark, perfect the extraterritorial protection system of well-known trademark in our country. In respect of the reasonable restriction of the right of well-known trademark, it is prohibited to use the word "well-known trademark" or slogan in the packaging and advertising of goods, and to set reasonable restrictions on the transfer or licensing right of well-known trademark. Through research and analysis, we can provide reference for our legislation and maintain the integrity and rationality of well-known trademark system.
