【摘要】:當(dāng)今世界高新技術(shù)及其產(chǎn)業(yè)迅猛發(fā)展,科學(xué)技術(shù)更新?lián)Q代速度明顯加快,經(jīng)濟(jì)競爭呈現(xiàn)信息化、知識化和全球化趨勢,知識產(chǎn)權(quán)制度作為保護(hù)智力勞動成果的重要法律制度,在國家經(jīng)濟(jì)、社會發(fā)展和科技進(jìn)步中的戰(zhàn)略地位進(jìn)一步增強(qiáng),成為國家技術(shù)創(chuàng)新體系的重要組成部分,發(fā)揮著激勵創(chuàng)新、規(guī)范競爭、調(diào)整利益的重要作用。 企業(yè)專利戰(zhàn)略是從戰(zhàn)略的高度管理專利,使專利成為謀求最佳經(jīng)濟(jì)效益和競爭優(yōu)勢的手段。專利已日益成為企業(yè)的戰(zhàn)略性資源和獲取市場競爭優(yōu)勢的基礎(chǔ)。企業(yè)專利戰(zhàn)略直接影響其利用專利的效率和效益,而且事關(guān)企業(yè)市場競爭能力的提高。企業(yè)從產(chǎn)品的設(shè)計、生產(chǎn)到銷售、使用的各個環(huán)節(jié),都與專利等知識產(chǎn)權(quán)緊密相連,企業(yè)擁有專利的數(shù)量、利用的質(zhì)量和保護(hù)專利的能力,直接影響到其市場競爭地位。如果企業(yè)不重視專利戰(zhàn)略,就難以發(fā)揮其擁有的專利的效能。 現(xiàn)在流行著一種說法:“一流企業(yè)賣標(biāo)準(zhǔn),二流企業(yè)賣技術(shù),三流企業(yè)賣產(chǎn)品。”當(dāng)前,美、日、歐盟等發(fā)達(dá)國家與地區(qū)基于其科技經(jīng)濟(jì)優(yōu)勢,積極推行專利戰(zhàn)略,通過日益強(qiáng)化的知識產(chǎn)權(quán)國際保護(hù)制度,將其技術(shù)優(yōu)勢借由專利變?yōu)槿蚴袌鰞?yōu)勢,使中國等發(fā)展中國家的科技經(jīng)濟(jì)發(fā)展空間受到嚴(yán)重擠壓。特別是近些年來,為了遏制我國汽車產(chǎn)業(yè)的發(fā)展,國外汽車企業(yè)憑借自身優(yōu)勢頻頻以侵犯知識產(chǎn)權(quán)為由,向我國汽車企業(yè)提起訴訟來構(gòu)筑新的貿(mào)易壁壘,以求占據(jù)更多的市場份額。研究我國汽車企業(yè)如何制定和實(shí)施專利戰(zhàn)略,如何突破跨國汽車企業(yè)的專利封鎖并與之同臺競爭,具有十分重要的現(xiàn)實(shí)意義。
[Abstract]:With the rapid development of high and new technologies and their industries in the world, the speed of upgrading science and technology has been quickened obviously, the economic competition has shown the trend of information, knowledge and globalization, and the intellectual property system is an important legal system to protect the achievements of intellectual labor. The strategic position in the national economy, social development and scientific and technological progress has been further strengthened and become an important part of the national technological innovation system, which plays an important role in stimulating innovation, standardizing competition and adjusting interests. The patent strategy of enterprise is to manage patent from the height of strategy, making patent become the means of seeking the best economic benefit and competitive advantage. Patent has increasingly become the strategic resources of enterprises and access to the basis of market competitive advantage. Enterprise patent strategy directly affects the efficiency and benefit of patent utilization, and it also relates to the improvement of enterprise market competition ability. The design, production, sale and use of products are closely related to the intellectual property rights such as patents. The quantity of patents, the quality of utilization and the ability to protect patents directly affect the market competition position of enterprises. If the enterprise does not attach importance to the patent strategy, it is difficult to give play to the effectiveness of the patent. Now there is a popular saying: "first-class enterprises sell standards, second-rate enterprises sell technology, third-rate enterprises sell products." At present, the United States, Japan, the European Union, and other developed countries and regions, based on their scientific, technological and economic advantages, are actively pursuing the patent strategy, turning their technological advantages from patents into global market advantages through the increasingly strengthened international protection system for intellectual property rights. China and other developing countries, the space for scientific and technological economic development has been severely squeezed. In particular, in recent years, in order to curb the development of China's automobile industry, foreign automobile enterprises frequently sue our automobile enterprises for infringing intellectual property rights on the basis of their own advantages to build new trade barriers. In order to occupy more market share. It is of great practical significance to study how to formulate and implement patent strategy and how to break through the patent blockade of multinational automobile enterprises and compete with them.
