【摘要】：論文首先對(duì)選題背景及意義、國(guó)內(nèi)外研究現(xiàn)狀、創(chuàng)新之處和研究方法進(jìn)行了說(shuō)明。制訂合理的版權(quán)政策是圖書(shū)館版權(quán)保護(hù)的有效措施之一,其意義在于表明圖書(shū)館對(duì)待版權(quán)問(wèn)題的態(tài)度,為用戶(hù)制訂使用圖書(shū)館網(wǎng)上資源的行為規(guī)范,宣傳了版權(quán)保護(hù)知識(shí),培養(yǎng)用戶(hù)的版權(quán)保護(hù)意識(shí)。與此同時(shí),通過(guò)制訂有效地版權(quán)政策可以規(guī)范圖書(shū)館與用戶(hù)之間的權(quán)利、責(zé)任與義務(wù),用以維系各方利益關(guān)系的相互平衡,促進(jìn)信息資源在圖書(shū)館中的科學(xué)配置和有效利用。本文主要采用了文獻(xiàn)調(diào)查法、歸納演繹法、網(wǎng)絡(luò)資源分析法、比較分析法等研究方法,對(duì)內(nèi)地“211”高校和臺(tái)灣地區(qū)國(guó)立高校的圖書(shū)館網(wǎng)站中的版權(quán)政策進(jìn)行調(diào)查,在分析其版權(quán)政策中的優(yōu)劣勢(shì)的基礎(chǔ)上,我們提出了改進(jìn)版權(quán)政策的措施。以期對(duì)我國(guó)高校圖書(shū)館網(wǎng)站版權(quán)政策的制訂,提供一定的現(xiàn)實(shí)參考價(jià)值。 在第二部分中,選取了內(nèi)地“211”高校共111所,臺(tái)灣地區(qū)的國(guó)立高校共52所,對(duì)這些高校圖書(shū)館網(wǎng)站中的版權(quán)政策進(jìn)行調(diào)查分析,并對(duì)版權(quán)政策中所涉及到的網(wǎng)站版權(quán)歸屬、制訂版權(quán)政策的目的及意義、受版權(quán)保護(hù)作品類(lèi)型、網(wǎng)站責(zé)任聲明及權(quán)利限制、超鏈接、電子資源合理使用、禁止性規(guī)定、違規(guī)問(wèn)題處理辦法、自建數(shù)據(jù)庫(kù)版權(quán)保護(hù)九個(gè)方面,逐一進(jìn)行了對(duì)比分析。 在第三部分中,通過(guò)對(duì)高校圖書(shū)館網(wǎng)站版權(quán)政策對(duì)比分析的基礎(chǔ)上,肯定了海峽兩岸高校版權(quán)政策中的優(yōu)勢(shì)。內(nèi)地高校圖書(shū)館網(wǎng)站版權(quán)政策的優(yōu)點(diǎn)包括重視對(duì)電子資源作品的版權(quán)保護(hù)；違規(guī)問(wèn)題處理辦法得當(dāng)；明確指出超鏈接服務(wù)的目的及鏈接方式。臺(tái)灣地區(qū)高校圖書(shū)館網(wǎng)站版權(quán)政策的優(yōu)點(diǎn)包括設(shè)置智慧財(cái)產(chǎn)權(quán)宣導(dǎo)網(wǎng)頁(yè)；受保護(hù)作品類(lèi)型廣泛；明確超鏈接網(wǎng)頁(yè)的版權(quán)歸屬,制訂作為被鏈接對(duì)象的版權(quán)政策；重視自建數(shù)據(jù)庫(kù)的版權(quán)保護(hù)。同時(shí)論文在第三部分中指出了海峽兩岸高校現(xiàn)有的版權(quán)政策中存在的不足之處,包括對(duì)版權(quán)政策重視程度不夠；版權(quán)政策貫徹執(zhí)行力度不夠；版權(quán)政策架構(gòu)不完整、表述不清晰；不重視免責(zé)聲明或聲明不當(dāng)；超鏈接政策制訂的缺失；對(duì)版權(quán)管理信息政策缺乏認(rèn)識(shí)；缺乏對(duì)數(shù)據(jù)庫(kù)版權(quán)保護(hù)意識(shí)。 第四部分主要是針對(duì)政策中的不足提出相應(yīng)的改進(jìn)措施。其內(nèi)容主要包括：制訂合理有效的版權(quán)政策、重視對(duì)超鏈接政策的制訂和實(shí)施、加強(qiáng)對(duì)電子資源的版權(quán)保護(hù)、重視對(duì)版權(quán)管理信息的保護(hù)、加強(qiáng)對(duì)高校自建數(shù)據(jù)庫(kù)的版權(quán)保護(hù)、加強(qiáng)技術(shù)保護(hù)措施在圖書(shū)館網(wǎng)站版權(quán)保護(hù)中的應(yīng)用這六個(gè)方面。 第五部分為結(jié)語(yǔ)與展望。指出圖書(shū)館版權(quán)問(wèn)題的解決應(yīng)該把握好知識(shí)產(chǎn)權(quán)保護(hù)和社會(huì)公眾利益之間的平衡。高校圖書(shū)館可以從多方面入手加強(qiáng)對(duì)版權(quán)的保護(hù),包括提高版權(quán)保護(hù)危機(jī)意識(shí)；加強(qiáng)版權(quán)宣傳教育工作；提高圖書(shū)館員版權(quán)保護(hù)素養(yǎng)；制訂版權(quán)管理制度等。
[Abstract]:Firstly, this paper explains the background and significance of the topic, the current research situation at home and abroad, the innovation and the research methods. Making reasonable copyright policy is one of the effective measures to protect the copyright of library. Its significance lies in showing the attitude of library to the copyright problem, formulating the code of conduct for users to use the library's online resources, and propagating the knowledge of copyright protection. Cultivate users' awareness of copyright protection. At the same time, by making effective copyright policy, we can standardize the rights, responsibilities and obligations between the library and the users, so as to maintain the mutual balance of the interests of all parties, and promote the scientific allocation and effective utilization of information resources in the library. This paper mainly adopts the methods of literature investigation, inductive deduction, network resource analysis, comparative analysis and so on, to investigate the copyright policies in the websites of the "211" universities in the mainland and the national universities in Taiwan. On the basis of analyzing the advantages and disadvantages of the copyright policy, we put forward some measures to improve the copyright policy. In order to provide some practical reference value for the establishment of copyright policy of university library website in our country. In the second part, 111 "211" universities in the mainland and 52 national universities in Taiwan are selected to investigate and analyze the copyright policy in the websites of these university libraries, and the copyright ownership of the websites involved in the copyright policy is analyzed. The purpose and significance of formulating copyright policies, the types of works protected by copyright, the liability statements and restrictions on rights of websites, hyperlinks, the rational use of electronic resources, the prohibition of regulations, the handling of irregularities, and the copyright protection of self-built databases, A comparative analysis is made one by one. In the third part, on the basis of comparative analysis of copyright policy of university library website, this paper affirms the advantages of university copyright policy on both sides of the Taiwan Strait. The advantages of copyright policy of university library website in mainland China include attaching importance to copyright protection of electronic resources works; dealing with illegal issues properly; pointing out clearly the purpose and mode of hyperlink service. The advantages of copyright policy of university library website in Taiwan include setting up intellectual property rights propaganda web page, protecting works in a wide range of types, defining copyright ownership of hyperlinked web pages, and formulating copyright policies as linked objects. Attach importance to the copyright protection of self-built database. At the same time, in the third part, the thesis points out the shortcomings of the existing copyright policies of universities and colleges on both sides of the Taiwan Strait, including the insufficient attention to copyright policies, the insufficient enforcement of copyright policies, and the lack of enforcement of copyright policies. The framework of copyright policy is incomplete and the expression is not clear; disclaimer or disclaimer is not paid attention to; lack of hyperlink policy; lack of understanding of copyright management information policy; lack of awareness of copyright protection in database. The fourth part is to put forward the corresponding improvement measures in view of the shortcomings of the policy. The main contents include: making reasonable and effective copyright policy, paying attention to the formulation and implementation of hyperlink policy, strengthening the copyright protection of electronic resources, attaching importance to the protection of copyright management information, and strengthening the copyright protection of self-built databases in colleges and universities. Strengthen the technical protection measures in the library website copyright protection application of these six aspects. The fifth part is the conclusion and prospect. It is pointed out that the balance between the protection of intellectual property rights and the interests of the public should be well balanced to solve the copyright problems in libraries. The university library can strengthen the protection of copyright from many aspects, including raising the crisis consciousness of copyright protection, strengthening the work of copyright propaganda and education, improving the quality of copyright protection of librarians, formulating the copyright management system and so on.
