“微信”商標(biāo)的注冊爭議評析及其解決路徑

【摘要】:商標(biāo)評審委員會(huì)(以下簡稱"商評委")對"微信"商標(biāo)不予注冊的裁定以及北京知識(shí)產(chǎn)權(quán)法院作出維持商評委裁定的一審判決,在商標(biāo)理論界和實(shí)務(wù)界引起了軒然大波。"微信"商標(biāo)能否注冊,除標(biāo)志本身是否具有顯著性以外,案件的焦點(diǎn)還在于《商標(biāo)法》第10條第1款第(8)項(xiàng)的"不良影響"應(yīng)該如何認(rèn)定和適用。"不良影響"雖然是一種兜底性質(zhì)的條款,但其適用也應(yīng)遵循一定的法律理路,有其特定的界限,標(biāo)志的"不良影響"應(yīng)從其本身或其構(gòu)成要素的"音、形、義"方面加以判斷,不可作任意的擴(kuò)張性解釋。解決這一爭議,需要從延遲公開這一技術(shù)層面進(jìn)行改善以及運(yùn)用商標(biāo)共存理念予以克服。
[Abstract]:The decision of the Trademark Review and Adjudication Board (hereinafter referred to as "the Merchants jury") not to register the trademark of WeChat and the decision of the Beijing intellectual property Court to uphold the ruling of the Commercial jury have caused a great uproar in the trademark theoretical and practical circles. " Apart from the significance of the logo itself, the focus of the case is how the "adverse effects" of Article 10 (1) (8) of the Trademark Law should be identified and applied. " Although "adverse influence" is a kind of clause with a bottom character, its application should also follow a certain legal principle and have its specific limits. The "adverse effect" of the mark should be judged from the aspects of "sound, shape and meaning" of its own or its constituent elements. There can be no arbitrary expansionary interpretation. To resolve this dispute, we need to improve the technology of delayed disclosure and use the concept of trademark coexistence to overcome it.
