【摘要】：在信息網(wǎng)絡(luò)傳播權(quán)框架下,涉及網(wǎng)絡(luò)深層鏈接的侵權(quán)行為判定在我國是個長期沒有合理答案的法律難題,帶來了廣泛的司法困惑和兩難選擇,相應(yīng)理論分析也多有不足之處。根據(jù)其技術(shù)基礎(chǔ)和行為后果,可把網(wǎng)絡(luò)鏈接分為指示鏈接和提供鏈接兩類。"指示鏈接"僅向公眾提供作品的網(wǎng)絡(luò)地址信息,可在網(wǎng)絡(luò)用戶點(diǎn)擊后指引用戶跳轉(zhuǎn)至被鏈網(wǎng)站獲得作品。"提供鏈接"除可能提供作品網(wǎng)絡(luò)地址信息外,還能夠使網(wǎng)絡(luò)用戶可以在設(shè)鏈網(wǎng)站獲得作品,從而構(gòu)成作品提供行為并可能直接侵犯信息網(wǎng)絡(luò)傳播權(quán)。細(xì)分網(wǎng)絡(luò)鏈接行為并界定其各自的法律性質(zhì)和法律責(zé)任,可望有助于解決涉及網(wǎng)絡(luò)深層鏈接之侵權(quán)行為判定的法律難題,相應(yīng)的信息網(wǎng)絡(luò)傳播權(quán)法律適用困境亦可得到一定突破。
[Abstract]:Under the framework of information network communication right, the judgment of tort involving the deep link of network is a legal problem which has no reasonable answer for a long time in our country, which has brought extensive judicial confusion and dilemma choice, and the corresponding theoretical analysis has many deficiencies. According to its technical basis and behavioral consequences, web links can be divided into two categories: indicative links and providing links. " The link "only provides the public with the online address information of the work, and can direct the user to jump to the linked website to obtain the work after the user clicks on it." In addition to providing the network address information of the work, the network user can also obtain the work on the linked website, which constitutes the act of providing the work and may directly infringe the right of information dissemination on the network. Subdividing the behavior of network link and defining their respective legal nature and legal liability are expected to be helpful to solve the legal problem of the judgment of tort involving deep link on the network. The corresponding information network dissemination right legal application dilemma can also get a certain breakthrough.
