【摘要】：隨著國(guó)際貿(mào)易的廣闊發(fā)展和科學(xué)技術(shù)交流的日益頻繁，知識(shí)產(chǎn)權(quán)已經(jīng)與國(guó)際貿(mào)易緊密相連，其中知識(shí)產(chǎn)權(quán)的侵權(quán)問(wèn)題亦逐漸演變?yōu)閲?guó)際貿(mào)易中的突出問(wèn)題。而我國(guó)已經(jīng)加入世界貿(mào)易組織，保護(hù)知識(shí)產(chǎn)權(quán)，禁止侵權(quán)貨物的進(jìn)出口不僅是我國(guó)遵守TRIPS協(xié)議的一項(xiàng)重要承諾，也是我國(guó)維護(hù)國(guó)際經(jīng)濟(jì)秩序的必要措施。經(jīng)過(guò)近二十年的發(fā)展，，我國(guó)的知識(shí)產(chǎn)權(quán)邊境保護(hù)制度經(jīng)歷了從無(wú)到有、從不完善到相對(duì)健全的發(fā)展歷程。知識(shí)產(chǎn)權(quán)邊境保護(hù)已經(jīng)成為我國(guó)海關(guān)的一項(xiàng)日益重要的職責(zé)，相關(guān)法律法規(guī)日漸完善，海關(guān)執(zhí)法成熟高效，查獲了一大批的侵權(quán)嫌疑貨物，成績(jī)顯著。但同時(shí)，我國(guó)知識(shí)產(chǎn)權(quán)邊境保護(hù)制度也存在不足，研究如何進(jìn)一步完善我國(guó)知識(shí)產(chǎn)權(quán)邊境保護(hù)制度體系，提高海關(guān)執(zhí)法效能，保護(hù)知識(shí)產(chǎn)權(quán)權(quán)利人的合法權(quán)利，在中國(guó)提出知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要，號(hào)召建設(shè)創(chuàng)新型國(guó)家的今天，具有非常重要的意義。 本文共分五個(gè)部分： 第一章對(duì)知識(shí)產(chǎn)權(quán)邊境保護(hù)制度做一個(gè)全方位的介紹，主要論述相關(guān)的概念、特征和法律性質(zhì)。 第二章對(duì)知識(shí)產(chǎn)權(quán)邊境保護(hù)制度進(jìn)行國(guó)際考察，主要通過(guò)對(duì)《TRIPs協(xié)議》、美國(guó)337條款、《歐盟條例》等知識(shí)產(chǎn)權(quán)邊境保護(hù)制度的研究，期望得出對(duì)我國(guó)有益的借鑒。 第三章是對(duì)我國(guó)知識(shí)產(chǎn)權(quán)邊境保護(hù)制度進(jìn)行介紹，主要介紹我國(guó)知識(shí)產(chǎn)權(quán)的行政保護(hù)，并論述我國(guó)知識(shí)產(chǎn)權(quán)邊境保護(hù)制度的法律淵源、主要內(nèi)容，總體我國(guó)近幾年知識(shí)產(chǎn)權(quán)邊境執(zhí)法情況，指出其中的不足。 第四章詳細(xì)論述我國(guó)知識(shí)產(chǎn)權(quán)邊境保護(hù)的執(zhí)法困惑，包括：知識(shí)產(chǎn)權(quán)權(quán)利人濫用權(quán)利的現(xiàn)象廣泛存在、專利權(quán)邊境保護(hù)效果不佳、中國(guó)特色的知識(shí)產(chǎn)權(quán)海關(guān)備案制度存有爭(zhēng)議、知識(shí)產(chǎn)權(quán)糾紛解決方式難以適應(yīng)現(xiàn)實(shí)的需要、郵遞快件渠道侵權(quán)狀況日益嚴(yán)重等。 第五章結(jié)合外國(guó)先進(jìn)關(guān)稅區(qū)的知識(shí)產(chǎn)權(quán)邊境保護(hù)制度與我國(guó)知識(shí)產(chǎn)權(quán)經(jīng)濟(jì)的現(xiàn)狀，綜合筆者在海關(guān)工作的實(shí)踐經(jīng)驗(yàn)，針對(duì)我國(guó)海關(guān)執(zhí)法的五個(gè)困惑，分別給出完善建議。
[Abstract]:With the wide development of international trade and the increasingly frequent exchange of science and technology, intellectual property rights have been closely linked with international trade, in which the infringement of intellectual property rights has gradually evolved into a prominent problem in international trade. China's entry into the World Trade Organization, the protection of intellectual property rights and the prohibition of the import and export of infringing goods are not only an important commitment for our country to abide by the TRIPS Agreement, but also a necessary measure for our country to maintain the international economic order. After nearly 20 years of development, our country's intellectual property border protection system has experienced from nothing to exist, from imperfect to relatively sound development process. The border protection of intellectual property has become an increasingly important duty of customs in China. The relevant laws and regulations are becoming more and more perfect, the customs law enforcement is mature and efficient, and a large number of suspected infringing goods have been seized, with remarkable achievements. But at the same time, our country's intellectual property border protection system also has the insufficiency, studies how to further consummate our country intellectual property rights border protection system, enhances the customs law enforcement efficiency, protects the intellectual property right holder's legal rights, It is of great significance to put forward the strategic outline of intellectual property in China and call for the construction of an innovative country. This paper is divided into five parts: the first chapter introduces the frontier protection system of intellectual property, mainly discusses the related concepts, characteristics and legal nature. The second chapter makes an international investigation on the intellectual property border protection system, mainly through the research on the intellectual property border protection system such as TRIPs Agreement, Section 337 of the United States, the European Union regulations and so on, hoping to draw useful lessons for our country. The third chapter introduces the border protection system of intellectual property rights in China, mainly introduces the administrative protection of intellectual property rights in China, and discusses the legal sources and main contents of the border protection system of intellectual property rights in China. In general, China's intellectual property law enforcement in recent years, pointing out the shortcomings. The fourth chapter discusses in detail the puzzlement of the enforcement of intellectual property rights border protection in China, including: the phenomenon of abuse of rights by intellectual property rights holders is widespread, the effect of patent rights border protection is not good, and the intellectual property rights customs record system with Chinese characteristics is controversial. The settlement of intellectual property disputes is difficult to meet the needs of reality, and the infringement of courier channels is becoming more and more serious. The fifth chapter combines the intellectual property border protection system of foreign advanced customs area and the present situation of intellectual property economy of our country, synthesizes the author's practical experience in customs work, and puts forward the perfect suggestions in view of the five puzzles of our country's customs law enforcement.
