【摘要】：在知識(shí)經(jīng)濟(jì)時(shí)代，企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資對(duì)生產(chǎn)發(fā)展和建設(shè)創(chuàng)新型國家都有著重要意義。當(dāng)前，我國企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資業(yè)務(wù)剛起步，相關(guān)理論研究還比較滯后，雖然實(shí)踐領(lǐng)域在積極進(jìn)行著有益的探索，但在法學(xué)理論和制度措施方面，仍有許多問題亟待研究。 本文針對(duì)企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資制度存在的問題，結(jié)合知識(shí)產(chǎn)權(quán)及權(quán)利質(zhì)權(quán)等基本理論，通過研究我國的法律法規(guī)和各地相關(guān)政策措施，為更好地發(fā)展、完善企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資制度提供一定參考。本文共分四個(gè)章節(jié)，對(duì)企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資制度的研究背景、相關(guān)的基本理論、我國企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資存在的問題以及完善相關(guān)制度的建議等幾個(gè)方面進(jìn)行了研究。 第一部分，導(dǎo)論。主要分析了企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資制度研究的背景、意義和國內(nèi)外研究的文獻(xiàn)綜述，以及本文的研究方法，創(chuàng)新點(diǎn)、難點(diǎn)和不足。 第二部分，企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資基本理論。主要闡述了知識(shí)產(chǎn)權(quán)和權(quán)利質(zhì)權(quán)的概念、性質(zhì)和特點(diǎn)以及權(quán)利質(zhì)權(quán)與動(dòng)產(chǎn)質(zhì)權(quán)的區(qū)別，其次分析了知識(shí)產(chǎn)權(quán)質(zhì)押融資的概念和特點(diǎn)，最后，精要概況分析了我國企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資的幾種模式。 第三部分，我國企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資制度存在的問題。提出了我國企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資制度發(fā)展過程中主要存在的幾點(diǎn)不足，包括企業(yè)對(duì)知識(shí)產(chǎn)權(quán)的認(rèn)識(shí)不足，法律法規(guī)的不健全，銀行業(yè)的支持力度不夠，知識(shí)產(chǎn)權(quán)評(píng)估機(jī)制的不完備，，融資過程中的風(fēng)險(xiǎn)難控制，政府的推動(dòng)作用不充分。 第四部分，完善我國企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資制度的建議。針對(duì)我國實(shí)踐中存在的問題，提出了幾點(diǎn)完善的建議，包括完善企業(yè)知識(shí)產(chǎn)權(quán)管理機(jī)制，完善企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資法律法規(guī)，增強(qiáng)銀行對(duì)企業(yè)知識(shí)產(chǎn)權(quán)質(zhì)押融資業(yè)務(wù)的支持力度，完善知識(shí)產(chǎn)權(quán)評(píng)估機(jī)制，構(gòu)建風(fēng)險(xiǎn)防控機(jī)制，創(chuàng)建知識(shí)產(chǎn)權(quán)交易市場，發(fā)揮政府的推動(dòng)作用。
[Abstract]:In the era of knowledge economy, intellectual property pledge financing is of great significance to the development of production and the construction of innovative country. At present, the business of intellectual property pledge financing in our country has just started, the relevant theory research is still lagging behind, although the practice field is actively carrying on the beneficial exploration, but in the legal theory and the system measure, there are still many problems that need to be studied urgently. This paper aims at the problems existing in the financing system of intellectual property pledge of enterprises, combining the basic theories of intellectual property rights and pledge of rights and so on, through studying the laws and regulations of our country and relevant policies and measures in various places, in order to develop better, Perfect enterprise intellectual property right pledge financing system to provide certain reference. This article is divided into four chapters, the research background of the enterprise intellectual property rights pledge financing system, the related basic theory, our country enterprise intellectual property rights pledge financing existence question as well as the consummation related system suggestion and so on several aspects has carried on the research. The first part, introduction. This paper mainly analyzes the background, significance and literature review of the research on enterprise intellectual property pledge financing system, as well as the research methods, innovations, difficulties and shortcomings of this paper. The second part, the enterprise intellectual property right pledge financing basic theory. This paper mainly expounds the concept, nature and characteristics of intellectual property and pledge of rights, and the difference between pledge of rights and pledge of movable property. Secondly, it analyzes the concept and characteristics of pledge financing of intellectual property. This paper analyzes several models of intellectual property pledge financing in China. The third part, our country enterprise intellectual property right pledge financing system existence question. The main problems in the development of intellectual property pledge financing system of Chinese enterprises are pointed out, including the insufficient understanding of intellectual property rights, the imperfect laws and regulations, and the insufficient support of the banking industry. The evaluation mechanism of intellectual property is not perfect, the risk in financing process is difficult to control, and the government's role in promoting it is not sufficient. The fourth part, consummates our country enterprise intellectual property right pledge financing system suggestion. In view of the problems existing in the practice of our country, this paper puts forward several suggestions, including perfecting the management mechanism of enterprise intellectual property, perfecting the laws and regulations of enterprise intellectual property mortgage financing. The bank should strengthen the support to the enterprise's intellectual property pledge financing business, perfect the intellectual property evaluation mechanism, construct the risk prevention and control mechanism, create the intellectual property transaction market, and give play to the government's promotion role.
