【摘要】：自改革開放以來,隨著市場經(jīng)濟(jì)體制的建立和完善,中國正經(jīng)歷著一個(gè)從單一社會(huì)向多樣型社會(huì)的轉(zhuǎn)型。利益格局的變化帶來了利益群體的多元化,能夠影響和參與政策過程的利益集團(tuán)逐步形成。但是由于利益集團(tuán)在我國發(fā)展時(shí)間較短,所以目前還存在著利益表達(dá)途徑不完善,表達(dá)方式不規(guī)范等問題。這就要求政府必須加強(qiáng)自身的制度建設(shè),建立和完善利益表達(dá)機(jī)制；建立和完善有效的法律體系,從而規(guī)范利益集團(tuán)的行為,維護(hù)社會(huì)的穩(wěn)定。 美國的利益集團(tuán)在其百余年的發(fā)展史中,經(jīng)歷了種種社會(huì)的變革、政策的變革,并探索出了適宜利益集團(tuán)發(fā)展的合理的政治制度體系。這些利益集團(tuán)在美國社會(huì)中扮演著重要的角色并影響著公共政策的制定。所以,對(duì)比研究美國的利益集團(tuán)發(fā)展規(guī)律及其對(duì)公共政策的影響對(duì)指導(dǎo)我國利益集團(tuán)均衡發(fā)展、維護(hù)公共利益、促進(jìn)社會(huì)和諧有著重要的意義。 本文綜述了國內(nèi)外學(xué)者對(duì)中美兩國利益集團(tuán)影響各自公共政策的研究；分析研究了利益集團(tuán)與公共政策的概念的發(fā)展和變遷,闡述了公共選擇相關(guān)理論和公共政策的相關(guān)理論；通過對(duì)比中美兩國利益集團(tuán)產(chǎn)生的政治文化背景論證了利益集團(tuán)在兩個(gè)政治體系中影響力不同的原因；通過對(duì)比分析現(xiàn)行的兩國利益集團(tuán)影響公共政策的方法,分析該方法在各國不同政治經(jīng)濟(jì)體制下所能發(fā)揮得作用以及利益集團(tuán)所扮演的角色。此外,本文從對(duì)知識(shí)產(chǎn)權(quán)和公共利益之間的沖突入手,研究了兩國不同知識(shí)產(chǎn)權(quán)相關(guān)利益集團(tuán)的利益傾向以及對(duì)政策的影響方式和影響力,并分析了其相同點(diǎn)和不同點(diǎn)。最后,論文給出了在中國現(xiàn)行制度下規(guī)范中國利益集團(tuán)發(fā)展的建議以保護(hù)公共利益、維護(hù)社會(huì)的穩(wěn)定發(fā)展。
[Abstract]:Since the reform and opening up, with the establishment and improvement of the market economy system, China is undergoing a transition from a single society to a diversified society. The change of interest pattern brings the diversification of interest groups, and the interest groups which can influence and participate in the policy process are gradually formed. However, because of the short development time of interest groups in China, there are still some problems, such as imperfect ways of expression of interests and non-standard ways of expression. This requires the government to strengthen its own system construction, to establish and improve the mechanism of interest expression, to establish and improve an effective legal system, so as to regulate the behavior of interest groups and maintain social stability. In its development history of more than 100 years, American interest groups have experienced various social changes and policy changes, and have explored a reasonable political system suitable for the development of interest groups. These interests play an important role in American society and influence public policy making. Therefore, a comparative study of the law of interest group development in the United States and its influence on public policy is of great significance in guiding the balanced development of interest groups in China, maintaining the public interest and promoting social harmony. This paper summarizes the domestic and foreign scholars' studies on the influence of interest groups in China and the United States on their respective public policies, analyzes the development and changes of the concepts of interest groups and public policies, and expounds the relevant theories of public choice and public policy. By comparing the political and cultural background of interest groups in China and the United States, the paper demonstrates the reasons why interest groups have different influence in the two political systems, and analyzes the methods by which interest groups in the two countries influence public policies. This paper analyzes the role that the method can play in different political and economic systems of various countries and the role of interest groups. In addition, starting with the conflict between intellectual property rights and public interests, this paper studies the interest tendency of different intellectual property rights related interest groups in the two countries, as well as their influence on policies, and analyzes their similarities and differences. Finally, the paper gives some suggestions to regulate the development of Chinese interest groups under the current system in order to protect the public interest and maintain the stable development of society.
