【摘要】：文章嘗試從商標(biāo)權(quán)經(jīng)濟屬性與法律屬性的視角研究商標(biāo)權(quán)價值形成和實現(xiàn)過程。商標(biāo)權(quán)價值由經(jīng)濟價值與法律價值兩部分構(gòu)成。經(jīng)濟價值取決于商譽價值法律化的過程,其價值大小受到財務(wù)、企業(yè)、消費者三方面因素的影響;法律價值體現(xiàn)在注冊商標(biāo)的法律保護過程中對商標(biāo)權(quán)價值的影響,即法律價值化過程,其價值大小與商標(biāo)權(quán)的法律屬性有很大關(guān)系,需要考慮知識產(chǎn)權(quán)的專有性、時間性和地域性特點。
[Abstract]:This paper attempts to study the formation and realization process of trademark value from the perspective of the economic and legal attributes of trademark rights. The value of trademark right consists of two parts: economic value and legal value. Economic value depends on the process of legalization of goodwill value, and its value is influenced by three factors: finance, enterprise and consumer, and the legal value is reflected in the influence of the legal protection of registered trademark on the value of trademark right. In other words, the value of legal value has a great relationship with the legal attribute of trademark right, so it is necessary to consider the proprietary, temporal and regional characteristics of intellectual property rights.
