【摘要】：目前,全球網(wǎng)絡(luò)作品侵權(quán)的情況愈演愈烈,我國也不例外。本文將針對網(wǎng)絡(luò)環(huán)境下著作權(quán)的概念和特征做出界定,討論并分析我國當(dāng)前網(wǎng)絡(luò)作品侵權(quán)問題的嚴(yán)重性,從而對侵權(quán)行為做出認(rèn)定,并提出必要的應(yīng)對策略。 本文從目前存在的各種數(shù)據(jù)資料入手,結(jié)合近幾年來國內(nèi)發(fā)生的網(wǎng)絡(luò)作品侵權(quán)的熱門案例,討論網(wǎng)絡(luò)環(huán)境下著作權(quán)侵權(quán)問題并得出一定的結(jié)論。文章主要分為四個(gè)部分：第一部分介紹了網(wǎng)絡(luò)環(huán)境下著作權(quán)的概念,對這一概念進(jìn)行總結(jié),并概括了網(wǎng)絡(luò)作品的新變化和特點(diǎn)。第二部分分析了網(wǎng)絡(luò)環(huán)境下著作權(quán)侵權(quán)的表現(xiàn),并論述了網(wǎng)絡(luò)作品侵權(quán)的行為認(rèn)定和賠償數(shù)額標(biāo)準(zhǔn)。第三部分在總結(jié)前文論述的基礎(chǔ)上,提出了相關(guān)的應(yīng)對策略,主要有技術(shù)措施的采取、司法管轄權(quán)的統(tǒng)一、知識產(chǎn)權(quán)庭的設(shè)置、著作權(quán)集體管理組織的完善、權(quán)利信息管理制度的和網(wǎng)絡(luò)道德的形成。
[Abstract]:At present, the global network works infringement situation intensified, our country is no exception. This paper will define the concept and characteristics of copyright under the network environment, discuss and analyze the seriousness of the current infringement of network works in our country, so as to identify the infringement, and put forward the necessary countermeasures. In this paper, starting from the existing data and materials, combined with the popular cases of network works infringement in recent years, this paper discusses the copyright infringement under the network environment and draws a certain conclusion. The article is divided into four parts: the first part introduces the concept of copyright under the network environment, summarizes the concept, and summarizes the new changes and characteristics of network works. The second part analyzes the performance of copyright infringement under the network environment, and discusses the behavior identification and compensation amount standard of network works infringement. In the third part, on the basis of summarizing the previous discussion, the author puts forward the relevant countermeasures, including the adoption of technical measures, the unification of jurisdiction, the establishment of intellectual property court, the perfection of collective management organization of copyright. The formation of right information management system and network morality.
