【摘要】：知識產(chǎn)權(quán)生態(tài)是一個全新的理論構(gòu)想,是馬克思主義關(guān)于法的本質(zhì)的思想的生動再現(xiàn),是馬克思主義基本原理的具體適用。運用生態(tài)學(xué)的智慧,不僅可以生動地詮釋知識產(chǎn)權(quán)作為法學(xué)問題根植于經(jīng)濟生活的本質(zhì),形象地反映其作為經(jīng)濟學(xué)問題受諸多因素影響的實際,而且全面、系統(tǒng)、準(zhǔn)確地概括了知識產(chǎn)權(quán)經(jīng)濟法律制度的價值。知識產(chǎn)權(quán)生態(tài)理論可以解釋法律制度實現(xiàn)過程中的所有問題,還可以發(fā)現(xiàn)理論研究導(dǎo)向的偏頗性。優(yōu)化知識產(chǎn)權(quán)生態(tài)是中國理論研究和實踐活動應(yīng)當(dāng)堅持的基本的思維導(dǎo)向。
[Abstract]:The ecology of intellectual property rights is a new theoretical conception, a vivid reproduction of Marxist thought on the essence of law, and a concrete application of the basic principles of Marxism. Using the wisdom of ecology can not only vividly explain the nature of intellectual property rights as a legal problem rooted in economic life, but also vividly reflect the fact that intellectual property rights are affected by many factors as economic problems, but also comprehensively and systematically. The value of intellectual property economic legal system is accurately summarized. The ecological theory of intellectual property can explain all the problems in the process of realizing the legal system, and it can also find the bias of the theoretical research direction. Optimizing the ecology of intellectual property is the basic thinking direction of China's theoretical research and practice.
