【摘要】：文化共享工程是由我國文化部、財(cái)政部、中央文明辦協(xié)同共建的社會(huì)網(wǎng)絡(luò)工程,它通過覆蓋全國的文化信息資源網(wǎng)絡(luò)向城市社區(qū)、農(nóng)村鄉(xiāng)鎮(zhèn)、邊防哨所等廣大基層單位和所有群眾提供優(yōu)秀的文化信息資源,可以說是在互聯(lián)網(wǎng)上中華文化基地的建設(shè),也是對(duì)中華民族優(yōu)秀文化的傳播。為了貫徹其宗旨——徹底消除文化信息資源獲取的不平等,文化共享工程在其實(shí)施過程中需要搜集、整理、開發(fā)、傳播海量作品,一方面它擔(dān)負(fù)著文化傳承的責(zé)任,另一方面它面臨著海量授權(quán)難題。針對(duì)這一矛盾僵持現(xiàn)象,本文通過實(shí)地調(diào)查研究文化共享工程實(shí)施過程中具體的知識(shí)產(chǎn)權(quán)制度保護(hù)現(xiàn)狀,分析總結(jié)出包括知識(shí)產(chǎn)權(quán)保護(hù)與信息資源共享的沖突、文化共享工程信息資源建設(shè)中的知識(shí)產(chǎn)權(quán)問題和文化共享工程信息資源傳遞過程中的知識(shí)產(chǎn)權(quán)問題等文化共享工程在實(shí)施過程中所產(chǎn)生的理論層面和現(xiàn)實(shí)層面的知識(shí)產(chǎn)權(quán)問題,再對(duì)比國外類似工程的法律保護(hù)制度、政策方針及國際公約等,結(jié)合近年來我國學(xué)者對(duì)信息資源、圖書館等公共事業(yè)方面所涉及的知識(shí)產(chǎn)權(quán)問題的研究,最終從我國法律制度、地方政府政策、共享工程自身規(guī)章制度三方面入手進(jìn)行研究解剖,初步建立起一個(gè)基于共享工程知識(shí)產(chǎn)權(quán)從獲取到使用流程的知識(shí)產(chǎn)權(quán)保護(hù)制度三角模型,以期能夠從法律制度方面為文化共享工程之后的發(fā)展建設(shè)提供一些參考和建議。
[Abstract]:The Cultural sharing Project is a social network project co-constructed by the Ministry of Culture, the Ministry of Finance and the Central Civilization Office. It reaches urban communities, rural villages and towns through a network of cultural information resources covering the whole country. Border posts and other grass-roots units and all the masses provide excellent cultural information resources, which can be said to be the construction of the Chinese cultural base on the Internet and the dissemination of the excellent culture of the Chinese nation. In order to carry out its tenet-to eliminate the inequality in the access to cultural information resources, the cultural sharing project needs to collect, organize, develop and disseminate a large number of works during its implementation. On the one hand, it bears the responsibility of cultural inheritance. On the other hand, it faces the problem of massive authorization. In view of this contradiction deadlock phenomenon, this article through the field investigation studies the concrete intellectual property rights system protection present situation in the cultural sharing project implementation process, analyzes and summarizes includes the intellectual property rights protection and the information resources sharing conflict, The intellectual property problems in the construction of information resources of cultural sharing projects and the intellectual property problems in the process of transmission of information resources of cultural sharing projects, and so on, the theoretical and practical aspects of intellectual property issues arising from the implementation of cultural sharing projects. Comparing with the legal protection system, policy guidelines and international conventions of similar projects abroad, and combining with the research on intellectual property rights related to information resources, libraries and other public utilities in our country in recent years, finally, from the legal system of our country, Starting with the local government policy and the rules and regulations of the shared project itself, the author preliminarily establishes a triangular model of the intellectual property protection system based on the process of obtaining and using the intellectual property rights of the shared project. In order to provide some references and suggestions for the development and construction of cultural sharing project from the legal system.
